AN ACT relating to apprenticeships; authorizing the state apprenticeship council to deny an application for approval or to suspend, terminate, cancel, place conditions upon or place on probation an approved program of apprenticeship based upon certain findings by the labor commissioner or the division of industrial relations of the department of business and industry; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 610.095 is hereby amended to read as follows:
1-2 610.095 1. The state apprenticeship council shall:
1-3 [1.] (a) Register and approve or reject proposed programs and
1-4 standards for apprenticeship.
1-5 [2.] (b) After providing notice and a hearing and for good cause shown,
1-6 deny an application for approval of a program, suspend, terminate, cancel
1-7 or place conditions upon any approved program, or place an approved
1-8 program on probation[.] , for any violation of the provisions of this
1-9 chapter.
1-10 2. After providing notice and a hearing, the state apprenticeship
1-11 council may:
1-12 (a) Deny an application for approval of a program based upon a
1-13 finding:
1-14 (1) By the labor commissioner that an applicant has violated any
1-15 provision of chapter 608 of NRS; or
1-16 (2) By the division that an applicant has violated any provision of
1-17 chapter 618 of NRS.
2-1 (b) Suspend, terminate, cancel or place conditions upon any approved
2-2 program, or place an approved program on probation, based upon a
2-3 finding:
2-4 (1) By the labor commissioner that any violation of the provisions
2-5 of chapter 608 of NRS relating to the operation of the program has
2-6 occurred; or
2-7 (2) By the division that any violation of the provisions of chapter
2-8 618 of NRS relating to the operation of the program has occurred.
2-9 3. For the purposes of this section, the state apprenticeship council
2-10 may request information from the labor commissioner and the
2-11 administrator of the division for the purposes of making a finding
2-12 specified in subsection 2. Upon receipt of such a request, the labor
2-13 commissioner or the administrator shall provide the information within
2-14 15 days after receiving the request.
2-15 4. As used in this section, “division” means the division of industrial
2-16 relations of the department of business and industry.
