AN ACT relating to regional planning; authorizing a governing board for regional planning to enter certain cooperative and interlocal agreements; authorizing a governing board for regional planning and a regional planning commission jointly or separately to appoint subcommittees and advisory committees for certain purposes; removing the restriction on the number of members of the governing board that may serve on certain advisory committees; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 278.0265 is hereby amended to read as follows:
1-2 278.0265 The governing board:
1-3 1. Shall adopt such regulations as are necessary to carry out its specific
1-4 powers and duties.
1-5 2. Shall prescribe an appropriate course of at least 12 hours of training
1-6 in land use planning for the members of the regional planning commission.
1-7 The course of training must include, without limitation, training relating to:
1-8 (a) State statutes and regulations and local ordinances, resolutions and
1-9 regulations concerning land use planning; and
1-10 (b) The provisions of chapter 241 of NRS.
1-11 3. May establish and collect reasonable fees for the provision of any
1-12 service that is authorized pursuant to the provisions of NRS 278.026 to
1-13 278.029, inclusive.
1-14 4. May enter into an agreement pursuant to NRS 277.045 or 277.080
1-15 to 277.180, inclusive, for a purpose that is consistent with the provisions
1-16 of NRS 278.026 to 278.029, inclusive.
2-1 Sec. 2. NRS 278.0268 is hereby amended to read as follows:
2-2 278.0268 1. The governing board and the regional planning
2-3 commission may, jointly or separately, appoint subcommittees for any
2-4 purpose that is consistent with NRS 278.026 to 278.029, inclusive. A
2-5 subcommittee appointed pursuant to this subsection must be composed
2-6 only of:
2-7 (a) Members of the governing board or regional planning
2-8 commission, as appropriate, if the subcommittee is appointed separately;
2-9 or
2-10 (b) Members from both the governing board and the regional
2-11 planning commission, if the subcommittee is appointed jointly.
2-12 2. To assist in the formulation and the implementation of the
2-13 comprehensive regional plan, the governing board and the regional
2-14 planning commission may , jointly or separately, appoint advisory
2-15 committees to advise and report to the governing board, regional planning
2-16 commission[.] , director of regional planning or a combination of such
2-17 entities. [No more than three members of the governing board may serve
2-18 on any advisory committee and they must not constitute more than 20
2-19 percent of the membership of the committee.]
2-20 3. The governing board and the regional planning commission may,
2-21 jointly or separately, appoint advisory committees to examine issues that
2-22 affect the county in which the governing board and regional planning
2-23 commission are located. The governing board and regional planning
2-24 commission may appoint persons from outside the county in which the
2-25 governing board and regional planning commission are located and from
2-26 outside this state to serve on an advisory committee appointed pursuant
2-27 to this section. An advisory committee appointed pursuant to this
2-28 subsection may:
2-29 (a) Identify, examine and discuss regional issues that affect the
2-30 county in which the governing board and regional planning commission
2-31 are located, including, without limitation, issues relating to land use,
2-32 fiscal matters, air quality and infrastructure; and
2-33 (b) Make recommendations to the governing board, regional planning
2-34 commission, or both, concerning regional issues.
2-35 Sec. 3. This act becomes effective on July 1, 2001.
