AN ACT relating to motor vehicles; requiring that a statement of charges be presented to a person requesting the repair of a motor vehicle; removing certain exemptions from the provisions governing garages and garagemen; providing under certain circumstances for the waiver of the registration fee to operate a garage; providing under certain circumstances for the revocation of a certificate of registration to operate a garage; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 487.035 is hereby amended to read as follows:
1-2 487.035 1. [In every instance where] If charges are made for the
1-3 repair of [an automobile] a motor vehicle, the person making [such charge]
1-4 the charges shall present to the person requesting the repairs or the person
1-5 entitled to possession of the [automobile] motor vehicle a statement of the
1-6 charges containing the following information:
1-7 (a) The name and signature of the person authorizing or requesting the
1-8 repairs;
1-9 (b) A statement of the total charges;
1-10 (c) An itemization and description of all parts used to repair the
1-11 [automobile] motor vehicle indicating the charges made for each part;
1-12 (d) A statement of the charges made for labor; and
1-13 (e) A description of all other charges.
1-14 2. Any person violating this section is guilty of a misdemeanor.
2-1 3. In the case of [an automobile] a motor vehicle registered in the State
2-2 of Nevada , no lien for labor or materials provided under NRS 108.265 to
2-3 108.360, inclusive, may be enforced by sale or otherwise unless a
2-4 statement as described in subsection 1 has been given by delivery in person
2-5 or by certified mail to the last known address of the registered and the legal
2-6 owner of the [automobile.] motor vehicle. In all other cases , such notice
2-7 [shall] must be made to the last known address of the registered owner and
2-8 any other person known to have or to claim an interest in the [automobile.]
2-9 motor vehicle.
2-10 4. As used in this section, “motor vehicle” has the meaning ascribed
2-11 to it in NRS 487.550.
2-12 Sec. 2. NRS 487.555 is hereby amended to read as follows:
2-13 487.555 The provisions of NRS 487.530 to 487.570, inclusive, do not
2-14 apply to[:
2-15 1. An authorized inspection station, authorized maintenance station,
2-16 authorized station or fleet station that is licensed pursuant to the provisions
2-17 of NRS 445B.700 to 445B.845, inclusive, for actions taken within the
2-18 scope of that license.
2-19 2. A body shop that is licensed pursuant to the provisions of NRS
2-20 487.600 to 487.690, inclusive, for actions taken within the scope of that
2-21 license.
2-22 3. A] a service station that is exclusively engaged in the business of
2-23 selling motor vehicle fuel, lubricants or goods unrelated to the repair of
2-24 motor vehicles.
2-25 Sec. 3. NRS 487.560 is hereby amended to read as follows:
2-26 487.560 1. On and after January 1, 1998, a garageman shall register
2-27 with the department for authorization to operate a garage.
2-28 2. An application for registration must be on a form provided by the
2-29 department. The application must include:
2-30 (a) The name of the applicant, including each name under which he
2-31 intends to do business;
2-32 (b) The complete street address of each location from which the
2-33 applicant will be conducting business, including a designation of the
2-34 location that will be his principal place of business;
2-35 (c) A copy of the business license for each garage operated by the
2-36 applicant if the county or city in which the applicant operates a garage
2-37 requires such a license;
2-38 (d) The type of repair work offered at each garage operated by the
2-39 applicant;
2-40 (e) The number of mechanics employed at each garage operated by the
2-41 applicant;
2-42 (f) The statement required by NRS 487.563; and
2-43 (g) Any other information required by the department.
2-44 3. [For] Except as otherwise provided in this subsection, for each
2-45 garage operated by an applicant, the department shall charge a fee of $25
2-46 for the issuance or renewal of registration. If an applicant operates more
2-47 than one garage, he may file one application if he clearly indicates on the
2-48 application the location of each garage operated by the applicant and each
2-49 person responsible for the management of each garage. The department
3-1 shall waive the fee for the issuance or renewal of registration for a
3-2 person that is licensed as:
3-3 (a) An authorized inspection station, authorized maintenance station
3-4 or authorized station pursuant to chapter 445B of NRS;
3-5 (b) A manufacturer, distributor, dealer or rebuilder pursuant to
3-6 chapter 482 of NRS; or
3-7 (c) An automobile wrecker, salvage pool or body shop pursuant to
3-8 chapter 487 of NRS.
3-9 4. All fees collected pursuant to this section must be deposited with the
3-10 state treasurer to the credit of the account for regulation of salvage pools,
3-11 automobile wreckers, body shops and garages.
3-12 5. An applicant for registration or renewal of registration shall notify
3-13 the department of any material change in the information contained in his
3-14 application for registration or renewal within 10 days after his knowledge
3-15 of the change.
3-16 Sec. 4. NRS 487.563 is hereby amended to read as follows:
3-17 487.563 1. Each person who submits an application for registration
3-18 pursuant to the provisions of NRS 487.560 must include in the application
3-19 a written statement to the department that specifies whether he agrees to
3-20 submit to binding arbitration any claims against him arising out of a
3-21 contract for repairs made by him to a motor vehicle. If the person fails to
3-22 submit the statement to the department or specifies in the statement that he
3-23 does not agree to arbitrate those claims, the person shall file with the
3-24 department a bond in the amount of $5,000, with a corporate surety for the
3-25 bond that is licensed to do business in this state. The form of the bond must
3-26 be approved by the attorney general and be conditioned upon whether the
3-27 applicant conducts his business as an owner or operator of a garage without
3-28 fraud or fraudulent representation and in compliance with the provisions of
3-29 NRS 487.035, 487.530 to 487.570, inclusive, and 597.480 to 597.590,
3-30 inclusive.
3-31 2. The bond must be continuous in form and the total aggregate
3-32 liability on the bond must be limited to the payment of the total amount of
3-33 the bond.
3-34 3. In lieu of a bond required to be filed pursuant to the provisions of
3-35 subsection 1, a person may deposit with the department, pursuant to the
3-36 terms prescribed by the department:
3-37 (a) A like amount of money or bonds of the United States or of the State
3-38 of Nevada of an actual market value of not less than the amount fixed by
3-39 the department; or
3-40 (b) A savings certificate of a bank or savings and loan association
3-41 located in this state, which must indicate an account of an amount equal to
3-42 the amount of the bond that would otherwise be required pursuant to this
3-43 section and that the amount is unavailable for withdrawal except upon
3-44 order of the department. Interest earned on the certificate accrues to the
3-45 account of the applicant.
3-46 4. If a claim is arbitrated pursuant to the provisions of this section, the
3-47 proceedings for arbitration must be conducted in accordance with the
3-48 provisions of NRS 38.015 to 38.205, inclusive.
3-49 5. If a person:
4-1 (a) Submits the statement to the department specifying that he agrees to
4-2 arbitrate a claim pursuant to the provisions of subsection 1; and
4-3 (b) Fails to submit to binding arbitration any claim specified in that
4-4 subsection,
4-5 the person asserting the claim may notify the department of that fact. Upon
4-6 receipt of the notice, the department shall, after notice and hearing, revoke
4-7 or refuse to renew the certificate of registration of the person who failed to
4-8 submit the claim to arbitration.
4-9 6. If a person fails to comply with an order of a court that relates to
4-10 the repair of a motor vehicle, the department shall, after notice and
4-11 hearing, revoke or refuse to renew the certificate of registration of the
4-12 person who failed to comply with the order.
4-13 7. The department may reinstate or renew a certificate of registration
4-14 that is [revoked] :
4-15 (a) Revoked pursuant to the provisions of subsection 5 if the person
4-16 whose certificate of registration is revoked:
4-17 [(a)] (1) Submits the claim to arbitration pursuant to the provisions of
4-18 subsection 4 and notifies the department of that fact; or
4-19 [(b)] (2) Files a bond or makes a deposit with the department pursuant
4-20 to the provisions of this section.
4-21 (b) Revoked pursuant to the provisions of subsection 6 if the person
4-22 whose certificate of registration is revoked complies with the order of the
4-23 court.
4-24 Sec. 5. NRS 487.565 is hereby amended to read as follows:
4-25 487.565 1. If the department receives an application for registration
4-26 that contains the information required by NRS 487.560, it shall issue to the
4-27 applicant a certificate of registration for each garage operated by the
4-28 applicant. The certificate must contain the name of the applicant, the name
4-29 under which his business will be conducted, the address of his business and
4-30 the registration number for the garage.
4-31 2. A certificate of registration is valid for 1 year after the date of
4-32 issuance. A garageman may renew his registration by submitting to the
4-33 department:
4-34 (a) An application for renewal on a form provided by the department;
4-35 and
4-36 (b) [The] Except as otherwise provided in NRS 487.560, the fee for
4-37 renewal set forth in [NRS 487.560.] that section.
4-38 The application must include the statement required by NRS 487.563.
