AN ACT relating to education; making an appropriation to the Clark County School District for the creation of a pilot program to extend the school day of selected middle schools; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. There is hereby appropriated from the state general
1-2 fund to the Clark County School District the sum of $3,366,560 for the
1-3 creation of a pilot program to extend the school day of selected middle
1-4 schools.
1-5 2. The Clark County School District shall select six middle schools to
1-6 participate in the pilot program. At least three of the middle schools
1-7 selected must be designated as demonstrating need for improvement
1-8 pursuant to NRS 385.367 at the time that the selection is made.
1-9 3. Each school that is selected for participation in the pilot program
1-10 shall extend the school day by 20 minutes per day for each school year of
1-11 the biennium. The additional time must be devoted to providing
1-12 instruction:
1-13 (a) In the core academic subjects set forth in NRS 389.018 and any
1-14 additional subjects set forth in that section which the Clark County School
1-15 District determines must be included;
1-16 (b) That is designed to meet the standards of content and performance
1-17 established pursuant to NRS 389.520, as applicable for the grade level of
1-18 pupils enrolled in the school participating in the pilot program; and
2-1 (c) For remedial study, as appropriate.
2-2 The instruction required by this subsection must be provided in a manner
2-3 that is consistent with the plan to improve the achievement of the school’s
2-4 pupils, if applicable.
2-5 4. The Clark County School District shall:
2-6 (a) Use the money appropriated by subsection 1 to:
2-7 (1) Pay for the salaries, training or other compensation of teachers
2-8 and other educational personnel related to the extension of the school day
2-9 required by the pilot program, additional instructional materials required
2-10 for the pilot program, if any, and other additional operating costs
2-11 attributable to the operation of the pilot program, if any.
2-12 (2) Supplement and not replace the money that the Clark County
2-13 School District would otherwise expend for the instruction required by
2-14 subsection 3.
2-15 (3) Conduct an evaluation of the pilot program, in an amount not to
2-16 exceed $100,000.
2-17 (b) Account for the money separately.
2-18 5. The money appropriated by subsection 1 must not be used to:
2-19 (a) Settle or arbitrate disputes or negotiate settlements between an
2-20 organization that represents licensed employees of the school district and
2-21 the school district.
2-22 (b) Adjust the schedules of salaries and benefits of employees of the
2-23 school district.
2-24 6. The Clark County School District shall, on or before February 1,
2-25 2003, submit a report evaluating the pilot program to the Director of the
2-26 Legislative Counsel Bureau for transmission to the 72nd session of the
2-27 Nevada Legislature that includes, without limitation:
2-28 (a) The results of the evaluation conducted pursuant to subsection 4;
2-29 (b) The expenditures for each fiscal year during the biennium of the
2-30 money appropriated by subsection 1;
2-31 (c) The schools that participated in the pilot program;
2-32 (d) Data pertaining to the academic achievement and proficiency of
2-33 pupils before and after participation in the pilot program; and
2-34 (e) Any recommendations for legislation.
2-35 The Clark County School District may submit a follow-up report on or
2-36 before August 30, 2003, to the Director of the Legislative Counsel Bureau
2-37 for transmission to the 73rd session of the Nevada Legislature if the school
2-38 district desires to include additional information after completion of the
2-39 2002-2003 school year.
2-40 7. Any remaining balance of the appropriation made by subsection 1
2-41 must not be committed for expenditure after June 30, 2003, and reverts to
2-42 the state general fund as soon as all payments of money committed have
2-43 been made.
2-44 Sec. 2. This act becomes effective upon passage and approval.
