THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 241 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. A public body shall not consider at a meeting whether to:
1-4 (a) Take administrative action against a person; or
1-5 (b) Acquire real property owned by a person by the exercise of the
1-6 power of eminent domain,
1-7 unless the public body has given written notice to that person of the time
1-8 and place of the meeting.
1-9 2. The written notice required pursuant to subsection 1 must be:
1-10 (a) Delivered personally to that person at least 5 working days before
1-11 the meeting; or
2-1 (b) Sent by certified mail to the last known address of that person at
2-2 least 21 working days before the meeting.
2-3 A public body must receive proof of service of the written notice provided
2-4 to a person pursuant to this section before the public body may consider
2-5 a matter set forth in subsection 1 relating to that person at a meeting.
2-6 3. The written notice provided in this section is in addition to the
2-7 notice of the meeting provided pursuant to NRS 241.020.
2-8 Sec. 2. NRS 241.015 is hereby amended to read as follows:
2-9 241.015 As used in this chapter, unless the context otherwise requires:
2-10 1. “Action” means:
2-11 (a) A decision made by a majority of the members present during a
2-12 meeting of a public body;
2-13 (b) A commitment or promise made by a majority of the members
2-14 present during a meeting of a public body; or
2-15 (c) A vote taken by a majority of the members present during a meeting
2-16 of a public body.
2-17 2. Meeting” means [the] :
2-18 (a) The gathering of members of a public body at which a quorum is
2-19 present to deliberate toward a decision or to take action on any matter over
2-20 which the public body has supervision, control, jurisdiction or advisory
2-21 power.
2-22 (b) Any series of gatherings of members of a public body at which:
2-23 (1) Less than a quorum is present at any individual gathering;
2-24 (2) The members of the public body attending one or more of the
2-25 gatherings collectively constitute a quorum; and
2-26 (3) The series of gatherings were held with the intent to deliberate
2-27 toward a decision or take action on any matter over which the public
2-28 body has supervision, control, jurisdiction or advisory power.
2-29 The term includes, without limitation, such a series of gatherings
2-30 between individual members of the public body and an attorney employed
2-31 or retained by the public body regarding potential or existing litigation
2-32 involving a matter over which the public body has supervision, control,
2-33 jurisdiction or advisory power if the gatherings were held with the intent
2-34 to deliberate toward a decision or take action regarding the litigation.
2-35 3. Except as otherwise provided in this subsection, “public body”
2-36 means any administrative, advisory, executive or legislative body of the
2-37 state or a local government which expends or disburses or is supported in
2-38 whole or in part by tax revenue or which advises or makes
2-39 recommendations to any entity which expends or disburses or is supported
2-40 in whole or in part by tax revenue, including, but not limited to, any board,
2-41 commission, committee, subcommittee or other subsidiary thereof and
2-42 includes an educational foundation as defined in subsection 3 of NRS
2-43 388.750 and a university foundation as defined in subsection 3 of NRS
2-44 396.405. “Public body” does not include the legislature of the State of
2-45 Nevada.
2-46 4. “Quorum” means a simple majority of the constituent membership
2-47 of a public body or another proportion established by law.
