AN ACT relating to the legislature; providing for an annual adjustment of the compensation for a legislator based on the consumer price index; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 218.210 is hereby amended to read as follows:

1-2    218.210  [Each]

1-3    1.  Except as otherwise provided in subsection 3, each senator and

1-4  assemblyman is entitled to receive as compensation [$130] the amount set

1-5  forth in subsection 2 per day for each day of service:

1-6    [1.] (a) During any regular session, for the number of days the

1-7  legislature is in session, or in adjournment for not more than 3 days, or the

1-8  maximum number of days for which compensation for a regular session is

1-9  permitted by the constitution, whichever is smaller; and

1-10    [2.] (b) During any special session, for the number of days the

1-11  legislature is in session or the maximum number of days for which

1-12  compensation for a special session is permitted by the constitution,

1-13  whichever is smaller.

1-14    2.  The amount each senator and assemblyman is entitled to receive

1-15  per day pursuant to subsection 1 is $130, cumulatively increased on July

1-16  1 of each year in an amount corresponding to the percentage of increase

1-17  in the Consumer Price Index (All Items) published by the United States

1-18  Department of Labor for the preceding fiscal year. The amount of

1-19  compensation per day pursuant to this subsection must not decrease.


2-1    3.  The amount each senator or assemblyman elected before

2-2  November 5, 2002, or appointed to succeed a senator or assemblyman

2-3  elected before November 5, 2002, is entitled to receive per day pursuant

2-4  to subsection 1 is $130.

2-5    Sec. 2.  NRS 218.210 is hereby amended to read as follows:

2-6    218.210  1.  [Except as otherwise provided in subsection 3, each]

2-7  Each senator and assemblyman is entitled to receive as compensation the

2-8  amount set forth in subsection 2 per day for each day of service:

2-9    (a) During any regular session, for the number of days the legislature is

2-10  in session, or in adjournment for not more than 3 days, or the maximum

2-16    2.  The amount each senator and assemblyman is entitled to receive per

2-17  day pursuant to subsection 1 is $130, cumulatively increased on July 1 of

2-18  each year in an amount corresponding to the percentage of increase in the

2-19  Consumer Price Index (All Items) published by the United States

2-20  Department of Labor for the preceding fiscal year. The amount of

2-21  compensation per day pursuant to this subsection must not decrease.

2-22    [3.  The amount each senator or assemblyman elected before November

2-23  5, 2002, or appointed to succeed a senator or assemblyman elected before

2-24  November 5, 2002, is entitled to receive per day pursuant to subsection 1 is

2-25  $130.]

2-26    Sec. 3.  1.  This section and section 1 of this act become effective on

2-27  October 1, 2001.

2-28    2.  Section 2 of this act becomes effective on November 2, 2004.
