AN ACT relating to public officers; increasing the annual salaries of certain elected county officers; requiring an annual increase of such salaries under certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 245.043 is hereby amended to read as follows:
1-2 245.043 1. As used in this section:
1-3 (a) “County” includes Carson City.
1-4 (b) “County commissioner” includes the mayor and supervisors of
1-5 Carson City.
1-6 2. Except as otherwise provided in subsection 3 or by any special law,
1-7 the elected officers of the counties of this state are entitled to receive
1-8 annual salaries in the base amounts specified in the following table. The
1-9 annual salaries are in full payment for all services required by law to be
1-10 performed by such officers. Except as otherwise provided by law, all fees
1-11 and commissions collected by such officers in the performance of their
1-12 duties must be paid into the county treasury each month without deduction
1-13 of any nature.

2-41 3. On July 1, 2002, and each July 1 thereafter, the board of county
2-42 commissioners of a county shall increase the annual salaries of the
2-43 elected officers of the county set forth in subsection 2 by the lesser of:
2-44 (a) The average percentage by which the salaries of all employees of
2-45 the county were increased during the previous fiscal year; or
3-1 (b) The percentage by which the average industrial hourly wage in the
3-2 county increased during the previous fiscal year, as determined on July 1
3-3 of each year by the employment security division of the department of
3-4 employment, training and rehabilitation.
3-5 Increases to the annual salaries of the elected officers of the county
3-6 pursuant to this subsection are cumulative.
3-7 4. On or before July 1 of a fiscal year, the board of county
3-8 commissioners of a county may apply to the committee on local
3-9 government finance for a waiver from the requirement of granting an
3-10 increase in the annual salaries of the elected officers of the county for
3-11 the next fiscal year pursuant to subsection 3 if the board determines that
3-12 the financial resources of the county are insufficient to pay the increase
3-13 in the next fiscal year. The committee on local government finance shall
3-14 grant such a waiver if it finds that the financial resources of the county
3-15 are insufficient to pay the increase in the next fiscal year.
3-16 Sec. 2. On or before July 1, 2001, the board of county commissioners
3-17 of a county may apply to the committee on local government finance for a
3-18 waiver from the applicability of the amendatory provisions of subsection 2
3-19 of section 1 of this act in fiscal year 2001-2002 if the board determines that
3-20 the financial resources of the county are insufficient to pay the increases set
3-21 forth in the amendatory provisions of subsection 2 of section 1 of this act in
3-22 fiscal year 2001-2002. The committee on local government finance shall
3-23 grant such a waiver for a period of not more than 1 year if it finds that the
3-24 financial resources of the county are insufficient to pay the increases set
3-25 forth in the amendatory provisions of subsection 2 of section 1 of this act in
3-26 fiscal year 2001-2002. The board of county commissioners may apply to
3-27 the committee on local government finance for one or more extensions of
3-28 the waiver granted to the county pursuant to this section. The committee on
3-29 local government finance shall extend such a waiver for a period of not
3-30 more than 1 year for each requested extension if it finds that the financial
3-31 resources of the county continue to be insufficient to pay the increases set
3-32 forth in the amendatory provisions of subsection 2 of section 1 of this act.
3-33 Sec. 3. The provisions of subsection 1 of NRS 354.599 do not apply
3-34 to any additional expenses of a local government that are related to the
3-35 provisions of this act.
3-36 Sec. 4. This act becomes effective on July 1, 2001.
