AN ACT relating to public officers; increasing the annual salaries of certain elected county officers; requiring an annual increase of such salaries under certain circumstances; repealing prospectively the payment of longevity for elected county officers; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1.  NRS 245.043 is hereby amended to read as follows:

1-2    245.043  1.  As used in this section:

1-3    (a) “County” includes Carson City.

1-4    (b) “County commissioner” includes the mayor and supervisors of

1-5  Carson City.

1-6    2.  Except as otherwise provided in subsection 3 or by any special law,

1-7  the elected officers of the counties of this state are entitled to receive

1-8  annual salaries in the base amounts specified in the following table. The

1-9  annual salaries are in full payment for all services required by law to be

1-10  performed by such officers. Except as otherwise provided by law, all fees

1-11  and commissions collected by such officers in the performance of their

1-12  duties must be paid into the county treasury each month without deduction

1-13  of any nature.

2-41    3.  Upon a determination by the board of county commissioners

2-42  pursuant to subsection 4 to implement the increase provided in this

2-43  subsection or the denial of a waiver requested pursuant to subsection 5,


3-1  the annual salaries of the elected officers of the county set forth in

3-2  subsection 2 must be increased on July 1, 2002, and each July 1

3-3  thereafter by the lesser of:

3-4    (a) The average percentage by which the salaries of all employees of

3-5  the county were increased during the previous fiscal year; or

3-6    (b) The percentage by which the average hourly wage in the county

3-7  increased during the previous fiscal year, as determined on July 1 of

3-8  each year by the employment security division of the department of

3-9  employment, training and rehabilitation.

3-10  Increases in the annual salaries of the elected officers of the county

3-11  required pursuant to this section are cumulative.

3-12    4.  At a regular meeting held on or before July 1 of each fiscal year,

3-13  the board of county commissioners shall:

3-14    (a) Implement an increase in the annual salaries of the elected

3-15  officers of the county based on the calculation set forth in subsection 3, if

3-16  any; or

3-17    (b) Request a waiver pursuant to subsection 5 from the requirement of

3-18  implementing the increase in the salaries.

3-19    5.  The board of county commissioners may apply to the committee on

3-20  local government finance for a waiver from the requirement of granting

3-21  an increase in the annual salaries of the elected officers of the county for

3-22  the next fiscal year pursuant to subsection 3 if the board determines that

3-23  the financial resources of the county are insufficient to pay the increase

3-24  in the next fiscal year. The committee on local government finance shall

3-25  grant such a waiver if it finds that the financial resources of the county

3-26  are insufficient to pay the increase in the next fiscal year.

3-27    Sec. 2.  NRS 245.044 is hereby repealed.

3-28    Sec. 3.  Notwithstanding the provisions of section 2 of this act that

3-29  repeal NRS 245.044, an elected county officer who is serving a term of

3-30  office on July 1, 2001, and who is eligible to receive the additional salary

3-31  provided in NRS 245.044 is entitled to continue to receive credit for

3-32  service for the calculation of that additional salary until the expiration of

3-33  his current term and his salary must be increased accordingly as if NRS

3-34  245.044 is not repealed by this act. For each calendar year that an elected

3-35  officer serves after the expiration of the term which he is serving as of July

3-36  1, 2001, the board of county commissioners shall continue to pay the

3-37  additional salary of the elected officer based on the percentage of

3-38  additional salary payable to the elected officer pursuant to this section in

3-39  the final year of his current term.

3-40    Sec. 4.  1.  At the first regular meeting of the board of county

3-41  commissioners of a county on or after the effective date of this section, the

3-42  board shall determine whether to:

3-43    (a) Implement the annual salaries of the elected officers of the county

3-44  set forth in subsection 2 of  NRS 245.043, as amended by this act; or

3-45    (b) Request a waiver from the applicability of subsection 2 of NRS

3-46  245.043, as amended by this act, in the manner set forth in subsection 2.

3-47    2.  The board of county commissioners of a county may apply to the

3-48  committee on local government finance for a waiver from the applicability

3-49  of subsection 2 of NRS 245.043, as amended by this act, in fiscal year


4-1  2001-2002 if the board determines that the financial resources of the

4-2  county are insufficient to pay the increases set forth in that subsection in

4-3  fiscal year 2001-2002. The committee on local government finance shall

4-4  grant such a waiver for a period of not more than 1 year if it finds that the

4-5  financial resources of the county are insufficient to pay the increases set

4-6  forth in subsection 2 of NRS 245.043, as amended by this act, in fiscal year

4-7  2001-2002. The board of county commissioners may apply to the

4-8  committee on local government finance for one or more extensions of the

4-9  waiver granted to the county pursuant to this section. The committee on

4-10  local government finance shall extend such a waiver for a period of not

4-11  more than 1 year for each requested extension if it finds that the financial

4-12  resources of the county continue to be insufficient to pay the increases set

4-13  forth in subsection 2 of NRS 245.043, as amended by this act.

4-14    Sec. 5.  The provisions of subsection 1 of NRS 354.599 do not apply

4-15  to any additional expenses of a local government that are related to the

4-16  provisions of this act.

4-17    Sec. 6.  1.  This section and section 4 of this act become effective

4-18  upon passage and approval.

4-19    2.  Sections 1, 2, 3 and 5 of this act become effective on July 1, 2001.

 

 

4-20  TEXT OF REPEALED SECTION

 

 

4-21    245.044 Payment for longevity for elected county officers.

4-22    1.  On and after July 1, 1973, if an elected county officer has served in

4-23   his office for more than 4 years, he is entitled to an additional salary of 2

4-24   percent of his base salary provided in NRS 245.043 for each full calendar

4-25   year he has served in his office.

4-26    2.  The additional salary provided in this section for an eligible county

4-27   officer:

4-28    (a) Must be computed on July 1 of each year by multiplying 2 percent

4-29   of the base salary provided in NRS 245.043 by the number of full calendar

4-30   years the elected county officer has served in his office; and

4-31    (b) Must not exceed 20 percent of the base salary provided in NRS

4-32   245.043.

4-33    3.  Service on the board of supervisors of Carson City for the initial

4-34   term which began on July 1, 1969, and ended on the first Monday of

4-35   January, 1973, shall be deemed to constitute 4 full calendar years of

4-36   service for the purposes of this section.
