AN ACT relating to higher education; requiring the legislative auditor to conduct an audit of the University and Community College System of Nevada and the Board of Regents of the University of Nevada; and providing other matters properly relating thereto.

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

1-1 Section 1. 1. The legislative auditor shall conduct an audit of the

1-2 University and Community College System of Nevada and the Board of

1-3 Regents of the University of Nevada.

1-4 2. The audit must include, without limitation, an analysis of:

1-5 (a) Capital construction projects;

1-6 (b) The cost of athletic programs, including, without limitation, the

1-7 sources and uses of money for such programs;

1-8 (c) The cost of administration, including, without limitation, personnel,

1-9 travel and other associated costs;

1-10 (d) The utilization of host accounts;

1-11 (e) The validity and reliability of enrollment data;

1-12 (f) The generation and distribution of investment income; and

1-13 (g) Statewide programs, including, without limitation, program

1-14 selection, funding and outcomes.

1-15 3. The legislative auditor shall present a final written report of the

1-16 audit to the audit subcommittee of the legislative commission not later than

1-17 February 3, 2003.

1-18 4. The provisions of NRS 218.737 to 218.890, inclusive, apply to the

1-19 audit conducted pursuant to this section.

2-1 Sec. 2. 1. Upon the request of the legislative auditor, the University

2-2 and Community College System of Nevada shall transfer from its budget to

2-3 the audit division of the legislative counsel bureau the sum of $90,000 to

2-4 carry out the provisions of section 1 of this act.

2-5 2. Any remaining balance of the sum transferred pursuant to

2-6 subsection 1 must not be committed for expenditure after February 3, 2003,

2-7 and reverts to the University and Community College System of Nevada as

2-8 soon as all payments of money committed have been made.

2-9 Sec. 3. This act becomes effective on July 1, 2001.
