AN ACT relating to motor vehicles; authorizing the director of the department of motor vehicles and public safety to enter into contracts with persons to assist in carrying out the duties of the department by providing any service that the motor vehicles branch of the department is authorized or required to provide; requiring the director to adopt certain regulations; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 481 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. Except as otherwise provided in NRS 482.160, if he determines it
1-4 to be in the best interests of this state, the director may by contract
1-5 appoint persons to assist in carrying out the duties of the department by
1-6 providing any service that the motor vehicles branch is authorized or
1-7 required to provide pursuant to this Title.
1-8 2. The director shall adopt such regulations as are necessary to carry
1-9 out the provisions of this section. The regulations must prescribe, without
1-10 limitation, the:
1-11 (a) Qualifications necessary for a person to be eligible for
1-12 appointment pursuant to this section;
1-13 (b) Form and frequency of reports concerning the services provided
1-14 by a person who is so appointed; and
1-15 (c) Requirements for periodic audits of such persons.
1-16 Sec. 2. NRS 481.0475 is hereby amended to read as follows:
1-17 481.0475 1. Any change in the organization of the department may
1-18 include the branches, divisions, functions and responsibilities described in
2-1 subsection 2 but must not include those described in paragraphs (d), (g)
2-2 and (h) of that subsection.
2-3 2. Unless the organization of the department is changed by the
2-4 director, the primary functions and responsibilities of the specified
2-5 branches and divisions of the department are as follows:
2-6 (a) The motor vehicles branch shall:
2-7 (1) [Execute,] Except as otherwise provided in a contract entered
2-8 into pursuant to section 1 of this act, execute, administer and enforce the
2-9 provisions of chapter 482 of NRS and perform such duties and exercise
2-10 such powers as may be conferred upon it pursuant to chapter 482 of NRS
2-11 and the provisions of any other laws;
2-12 (2) Execute and administer the laws relative to the licensing of motor
2-13 vehicle carriers and the use of public highways by those carriers [as
2-14 contained] set forth in chapter 706 of NRS;
2-15 (3) Perform such duties and exercise such powers as may be
2-16 conferred upon it pursuant to chapter 706 of NRS;
2-17 (4) Execute and administer the provisions of chapter 366 of NRS,
2-18 relating to the imposition and collection of taxes on special fuels used for
2-19 motor vehicles;
2-20 (5) Perform such duties and exercise such powers as may be
2-21 conferred upon it pursuant to chapter 366 of NRS;
2-22 (6) [Execute,] Except as otherwise provided in a contract entered
2-23 into pursuant to section 1 of this act, execute, administer and enforce the
2-24 provisions of chapter 483 of NRS and perform such duties and exercise
2-25 such powers as may be conferred upon it pursuant to chapter 483 of NRS;
2-26 (7) Execute, administer and enforce the provisions of chapter 485 of
2-27 NRS and perform such duties and exercise such powers as may be
2-28 conferred upon it pursuant to chapter 485 of NRS;
2-29 (8) [Execute,] Except as otherwise provided in a contract entered
2-30 into pursuant to section 1 of this act, execute, administer and enforce the
2-31 laws relating to the licensing of drivers of motorcycles and similar vehicles
2-32 in accordance with the provisions of chapter 486 of NRS;
2-33 (9) Execute, administer and enforce the provisions of chapter 487 of
2-34 NRS and perform such duties and exercise such powers as may be
2-35 conferred upon it pursuant to chapter 487 of NRS; and
2-36 (10) Execute, administer and enforce the provisions of chapter 108 of
2-37 NRS and perform such duties and exercise such powers relating to liens on
2-38 vehicles as may be conferred upon it pursuant to chapter 108 of NRS or the
2-39 provisions of any other laws.
2-40 (b) The administrative services division shall furnish fiscal, accounting
2-41 and other administrative services to the director and the various branches
2-42 and divisions, and advise and assist the director and the various branches
2-43 and divisions in carrying out their functions and responsibilities.
2-44 (c) The investigation division shall:
2-45 (1) Execute, administer and enforce the provisions of chapter 453 of
2-46 NRS relating to controlled substances and chapter 454 of NRS relating to
2-47 dangerous drugs;
2-48 (2) Assist the secretary of state in carrying out an investigation
2-49 pursuant to NRS 293.124; and
3-1 (3) Perform such duties and exercise such powers as may be
3-2 conferred upon it pursuant to this chapter and any other laws.
3-3 (d) The Nevada highway patrol division shall execute, administer and
3-4 enforce the provisions of chapter 484 of NRS and perform such duties and
3-5 exercise such powers as may be conferred upon it pursuant to NRS
3-6 481.180 and the provisions of any other laws.
3-7 (e) The division of emergency management shall execute, administer
3-8 and enforce the provisions of chapter 414 of NRS and perform such duties
3-9 and exercise such powers as may be conferred upon it pursuant to chapter
3-10 414 of NRS and the provisions of any other laws.
3-11 (f) The state fire marshal division shall execute, administer and enforce
3-12 the provisions of chapter 477 of NRS and perform such duties and exercise
3-13 such powers as may be conferred upon it pursuant to chapter 477 of NRS
3-14 and the provisions of any other laws.
3-15 (g) The division of parole and probation shall execute, administer and
3-16 enforce the provisions of chapters 176A and 213 of NRS relating to parole
3-17 and probation and perform such duties and exercise such powers as may be
3-18 conferred upon it pursuant to those chapters and the provisions of any other
3-19 laws.
3-20 (h) The capitol police division shall assist the chief of the buildings and
3-21 grounds division of the department of administration in the enforcement of
3-22 subsection 1 of NRS 331.140.
3-23 (i) The training division shall provide training to the employees of the
3-24 department.
3-25 Sec. 3. This act becomes effective:
3-26 1. Upon passage and approval for the purposes of entering into
3-27 contracts and adopting regulations pursuant to the provisions of section 1
3-28 of this act; and
3-29 2. On January 1, 2002, for all other purposes.
