AN ACT relating to juveniles; prohibiting an entity that supervises a juvenile who is ordered to perform work or community service from placing the juvenile on a highway except under certain circumstances or in any other dangerous situation; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 62 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  Except as otherwise provided in subsections 2 and 3, if a child is

1-4  required to perform any work or community service pursuant to this

1-5  chapter, the supervising entity shall not allow the child to perform the

1-6  work or community service on or near a highway or in any other

1-7  dangerous situation.

1-8    2.  A supervising entity may allow children to perform work or

1-9  community service on or near a controlled-access highway if:

1-10  (a) The children are not required to perform any work or service in

1-11  the median of the highway;

1-12  (b) The work or service is performed behind a guardrail or other

1-13  safety barrier;

1-14  (c) Appropriate warning signs are placed on the highway at least 100

1-15  yards in front of the location where the children are working from both

1-16  directions, as appropriate based on the speed of the vehicles traveling on

1-17  the highway;

1-18  (d) A vehicle with an amber light placed on top of the vehicle is placed

1-19  at the site in a manner which shields the children from traffic; and

1-20  (e) The children are required to wear reflective vests and orange hats.


2-1    3.  A supervising entity may allow children to perform work or

2-2  community service on or near a highway that does not have controlled

2-3  access if:

2-4    (a) The children are not required to perform any work or service in

2-5  the median of the highway;

2-6    (b) Appropriate warning signs are placed at least 100 yards in front of

2-7  the location where the children are working from both directions, as

2-8  appropriate based on the speed of the vehicles traveling on the highway;

2-9    (c) A vehicle with an amber light placed on top of the vehicle is placed

2-10  at the site in a manner which shields the children from traffic; and

2-11  (d) The children are required to wear reflective vests and orange hats.

2-12  4.  The supervising entity shall notify the parent or guardian of a

2-13  child whom it supervises of the nature and location of the work or

2-14  community service to be performed by the child before taking the child to

2-15  perform such work or service.

2-16  5.  As used in this section:

2-17  (a) “Community service” includes, without limitation, public service,

2-18  work on public projects, supervised work for the benefit of the

2-19  community or any other work required by the court.

2-20  (b) “Controlled-access highway” has the meaning ascribed to it in

2-21  NRS 484.041.

2-22  (c) “Highway” means a street, road or thoroughfare of any kind used

2-23  by the public.

2-24  (d) “Other dangerous situation” means any situation that poses a

2-25  reasonably foreseeable risk that serious bodily harm or injury to a child

2-26  could occur.

2-27  (e) “Supervising entity” means a person or entity who is responsible

2-28  for supervising children who are ordered to perform work or community

2-29  service pursuant to this chapter.

2-30  Sec. 2.  This act becomes effective upon passage and approval.
