AN ACT relating to libraries; requiring the board of county commissioners and the governing body of any city that is consolidated into the county library district to approve a proposal for the issuance of general obligation bonds for the consolidated library district; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 379.0225 is hereby amended to read as follows:

1-2    379.0225  1.  Except as otherwise provided in this subsection, the

1-3  trustees of a consolidated or county library district may propose the

1-4  issuance of general obligation bonds in an amount not to exceed 10 percent

1-5  of the total last assessed valuation of the taxable property of the district for

1-6  the purpose of acquiring, constructing or improving buildings and other

1-7  real property to be used for library purposes or for purchasing books,

1-8  materials or equipment for newly constructed libraries. The trustees of a

1-9  consolidated library district shall not propose an issuance of bonds or any

1-10  other form of indebtedness unless [a public hearing on the proposal is first

1-11  held before] the board of county commissioners and the governing body of

1-12  [the city .

1-13    2.  If the] each city that is consolidated into the county library district

1-14  each approve the proposal at a public hearing.

1-15    2.  If:

1-16    (a) The trustees of a county library district decide to propose the

1-17  issuance of bonds[,] ; or


2-1    (b) The trustees of a consolidated library district obtain approval

2-2  pursuant to subsection 1 to propose the issuance of bonds,

2-3  the proposal must be submitted by the trustees of the district to the debt

2-4  management commission of the county in which the district is situated,

2-5  pursuant to the provisions of NRS 350.001 to 350.006, inclusive. If the

2-6  debt management commission approves the proposed issuance, the

2-7  question of issuing the bonds must be submitted to the registered electors

2-8  of the district in accordance with the provisions of NRS 350.020 to

2-9  350.070, inclusive. If a majority of the electors voting on the question

2-10  favors the proposal, the board of county commissioners shall issue the

2-11  bonds as general obligations of the consolidated or county library district

2-12  pursuant to the provisions of the Local Government Securities Law.

2-13    3.  Any bond issued for purchasing books, materials or equipment for

2-14  newly constructed libraries must be redeemed within 5 years after its

2-15  issuance.
