AN ACT relating to industrial insurance; requiring an insurer to submit a written report concerning certain claims for compensation to the administrator of the division of industrial relations of the department of business and industry; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 617 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. Each insurer shall submit to the administrator a written report
1-4 concerning each claim for compensation that is filed with the insurer for
1-5 an occupational disease of the heart or lungs or any occupational disease
1-6 that is infectious or relates to cancer. The written report must be
1-7 submitted to the administrator within 30 days after the insurer accepts or
1-8 denies the claim pursuant to NRS 617.356 and must include:
1-9 (a) A statement specifying the nature of the claim;
1-10 (b) A statement indicating whether the insurer accepted or denied the
1-11 claim and the reasons for the acceptance or denial;
1-12 (c) A statement indicating the estimated medical costs for the claim;
1-13 and
1-14 (d) Any other information required by the administrator.
1-15 2. If a claim specified in subsection 1 is appealed or affirmed,
1-16 modified or reversed on appeal, or is closed or reopened, the insurer
1-17 shall notify the administrator of that fact in writing within 30 days after
1-18 the claim is appealed, affirmed, modified, reversed, closed or reopened.
2-1 3. On or before February 1 of each year, the administrator shall
2-2 prepare and make available to the general public a written report
2-3 concerning claims specified in subsection 1. The written report must
2-4 include:
2-5 (a) The information submitted to the administrator by an insurer
2-6 pursuant to this section during the immediately preceding year; and
2-7 (b) Any other information concerning those claims required by the
2-8 administrator.
2-9 Sec. 2. The provisions of section 1 of this act do not apply to a claim
2-10 for compensation specified in that section that is filed with an insurer
2-11 before January 1, 2001.
2-12 Sec. 3. This act becomes effective on July 1, 2001.
