AN ACT relating to education; requiring the board of trustees of a school district to obtain approval from the legislature to enter into certain contracts relating to the management of public schools; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 386 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  The board of trustees of a school district shall not enter into a

1-4  contract or other agreement to delegate to another its responsibility to

1-5  operate, manage or oversee a school of the school district that has been

1-6  designated as demonstrating need for improvement pursuant to NRS

1-7  385.367 or 385.368 unless the board of trustees has received approval to

1-8  enter into the agreement from the legislature by concurrent resolution.

1-9    2.  The board of trustees of a school district may submit a written

1-10  request for legislative approval pursuant to subsection 1 to the director of

1-11  the legislative counsel bureau for transmission to the legislature. A

1-12  written request must include, without limitation:

1-13    (a) A description of the action taken by the school and the school

1-14  district to improve the academic success of the school;

1-15    (b) A description of the adjustments in the allocation of the financial

1-16  resources of the school district that are necessary to improve the

1-17  academic success of the school; and


2-1    (c) The identity of the employees of the school district who were

2-2  primarily responsible for the decisions relating to the operation and

2-3  management of the school for the 4 years immediately preceding the date

2-4  of the request.

2-5    3.  If a contract or other agreement for the operation, management or

2-6  oversight of a school is approved by the legislature pursuant to this

2-7  section, the board of trustees of the school district that enters into the

2-8  agreement:

2-9    (a) Remains responsible for complying with all applicable statutes and

2-10  regulations relating to that school, including, without limitation, NRS

2-11  385.3455 to 385.391, inclusive; and

2-12    (b) If the superintendent of public instruction appoints a licensed

2-13  administrator to oversee that school pursuant to NRS 385.386, shall

2-14  ensure that the person or entity with whom the board has entered into the

2-15  contract complies with all recommendations and actions required by the

2-16  administrator who was appointed by the superintendent of public

2-17  instruction.

2-18    Sec. 2.  Section 1 of this act applies to the board of trustees of a school

2-19  district for any contract or other agreement entered into on or after the

2-20  effective date of this act, regardless of whether negotiations for the contract

2-21  or agreement began before that effective date.

2-22    Sec. 3. This act becomes effective upon passage and approval.
