AN ACT relating to electricians; requiring the division of industrial relations of the department of business and industry to establish minimum standards for the education, training and certification of electricians; authorizing the division to establish a schedule of fees for the certification of electricians; prohibiting a person from working as an electrician unless he holds a certificate as an electrician issued by the division; prohibiting the state contractors’ board from issuing a license to, or renewing the license of, an electrician who does not hold a certificate as an electrician issued by the division; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 618 of NRS is hereby amended by adding thereto
1-2 the provisions set forth as sections 2 to 7, inclusive, of this act.
1-3 Sec. 2. As used in sections 2 to 7, inclusive, of this act, unless the
1-4 context otherwise requires, “electrician” means any person who engages
1-5 in the connection of electrical devices for electrical contractors and
1-6 includes, without limitation, any person who holds a contractor’s license
1-7 in the specialty of electrical contracting issued by the state contractors’
1-8 board, but does not include a person who only engages in:
1-9 1. Electrical connections under 100 volt-amperes;
1-10 2. Electrical connections for a utility regulated by the public utilities
1-11 commission of Nevada, including, without limitation, engaging in
1-12 electrical connections within and without the facility and property of the
1-13 utility in furtherance of the generation, transmission or distribution of
1-14 natural gas or electricity; or
1-15 3. Electrical work ordinarily and customarily performed by
1-16 stationary engineers.
2-1 Sec. 3. The division shall adopt regulations establishing standards
2-2 for the education and training of electricians, including, without
2-3 limitation, regulations:
2-4 1. Requiring the establishment and implementation of programs for
2-5 the education, training and certification of electricians;
2-6 2. Requiring the annual certification of electricians; and
2-7 3. Establishing a schedule of reasonable fees for the issuance and
2-8 renewal of a certificate as an electrician.
2-9 Sec. 4. 1. The division shall issue a certificate as an electrician to a
2-10 person who:
2-11 (a) Successfully completes the required education and training
2-12 established by the division pursuant to section 3 of this act;
2-13 (b) Pays the required fee, if any, for the issuance of the certificate;
2-14 and
2-15 (c) Complies with all other requirements established by the division
2-16 for the issuance of the certificate.
2-17 2. A person shall not work as an electrician in this state unless he
2-18 holds a certificate as an electrician issued by the division pursuant to this
2-19 section.
2-20 Sec. 5. 1. An applicant for the issuance or renewal of a certificate
2-21 as an electrician shall submit with his application the statement
2-22 prescribed by the welfare division of the department of human resources
2-23 pursuant to NRS 425.520. The statement must be completed and signed
2-24 by the applicant.
2-25 2. The division of industrial relations shall include the statement
2-26 required pursuant to subsection 1 in:
2-27 (a) The application or any other forms that must be submitted for the
2-28 issuance or renewal of the certificate; or
2-29 (b) A separate form prescribed by the division.
2-30 3. The division shall not issue or renew a certificate as an electrician
2-31 if the applicant:
2-32 (a) Fails to submit the statement required pursuant to subsection 1; or
2-33 (b) Indicates on the statement submitted pursuant to subsection 1 that
2-34 he is subject to a court order for the support of a child and is not in
2-35 compliance with the order or a plan approved by the district attorney or
2-36 other public agency enforcing the order for the repayment of the amount
2-37 owed pursuant to the order.
2-38 4. If an applicant indicates on the statement submitted pursuant to
2-39 subsection 1 that he is subject to a court order for the support of a child
2-40 and is not in compliance with the order or a plan approved by the district
2-41 attorney or other public agency enforcing the order for the repayment of
2-42 the amount owed pursuant to the order, the person to whom the
2-43 application was submitted shall advise the applicant to contact the district
2-44 attorney or other public agency enforcing the order to determine the
2-45 actions that the applicant may take to satisfy the arrearage.
2-46 Sec. 6. An application for the issuance of a certificate as an
2-47 electrician pursuant to sections 2 to 7, inclusive, of this act must include
2-48 the social security number of the applicant.
3-1 Sec. 7. 1. If the division receives a copy of a court order issued
3-2 pursuant to NRS 425.540 that provides for the suspension of all
3-3 professional, occupational and recreational licenses, certificates and
3-4 permits issued to a person who holds a certificate as an electrician, the
3-5 division shall deem the certificate issued to that person to be suspended
3-6 at the end of the 30th day after the date on which the court order was
3-7 issued unless the division receives a letter issued by the district attorney
3-8 or other public agency pursuant to NRS 425.550 to the person who has
3-9 been issued the certificate stating that the person has complied with the
3-10 subpoena or warrant or has satisfied the arrearage pursuant to NRS
3-11 425.560.
3-12 2. The division shall reinstate a certificate as an electrician that has
3-13 been suspended by a district court pursuant to NRS 425.540 if the
3-14 division receives a letter issued by the district attorney or other public
3-15 agency pursuant to NRS 425.550 to the electrician whose certificate was
3-16 suspended stating that the electrician whose certificate was suspended
3-17 has complied with the subpoena or warrant or has satisfied the arrearage
3-18 pursuant to NRS 425.560.
3-19 Sec. 8. Chapter 624 of NRS is hereby amended by adding thereto a
3-20 new section to read as follows:
3-21 The board shall not issue or renew a specialty license in electrical
3-22 contracting to any person who does not hold a certificate as an
3-23 electrician issued by the division of industrial relations of the department
3-24 of business and industry pursuant to sections 2 to 7, inclusive, of this act.
3-25 Sec. 9. 1. This section and sections 1, 2 and 3 of this act become
3-26 effective upon passage and approval.
3-27 2. Sections 4 to 8, inclusive, of this act become effective on July 1,
3-28 2002.
3-29 3. The provisions of sections 5, 6 and 7 of this act expire by limitation
3-30 on the date on which the provisions of 42 U.S.C. § 666 requiring each state
3-31 to establish procedures under which the state has the authority to withhold
3-32 or suspend, or to restrict the use of, professional, occupational and
3-33 recreational licenses of persons who:
3-34 (a) Have failed to comply with a subpoena or warrant relating to a
3-35 proceeding to determine the paternity of a child or to establish or enforce
3-36 an obligation for the support of a child; or
3-37 (b) Are in arrears in the payment for the support of one or more
3-38 children,
3-39 are repealed by the Congress of the United States.
