AN ACT relating to the state personnel system; transferring the duty to certify state payrolls from the director of the department of personnel to the state controller; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 281.120 is hereby amended to read as follows:

1-2    281.120  1.  Except as otherwise provided in this section, all state

1-3  officers and regular and temporary employees of this state are entitled to

1-4  receive salaries as fixed by law in two equal semimonthly payments. The

1-5  first semimonthly payment for each month must be for the first half of that

1-6  particular month, and the second semimonthly payment must be for the last

1-7  half of the month.

1-8    2.  All payrolls must be submitted by individual agencies immediately

1-9  after the 15th and last day of each month for approval by the [department

1-10  of personnel, and salary] state controller. Salary checks , as approved by

1-11  the state controller , must be issued not later than 10 calendar days

1-12  following the end of each semimonthly pay period.

1-13    3.  A state agency or department may be permitted to pay salaries,

1-14  within the limits fixed by law, at regular 2-week intervals, when it is

1-15  established to the satisfaction of the governor that this method of payment

1-16  will expedite and assist the work of the agency or department without

1-17  inconvenience to other agencies or departments.

1-18    Sec. 2.  NRS 284.185 is hereby amended to read as follows:

1-19    284.185  The [state controller or any other state fiscal officer shall not

1-20  draw, sign, issue or authorize the drawing, signing or issuing of any


2-1  warrant on the state treasurer or other state disbursing officer, and the] state

2-2  treasurer or other state disbursing officer shall not pay any salary or

2-3  compensation to any person in the classified or unclassified service of the

2-4  state unless the payroll or account for the salary or compensation

2-5  containing the name of every person to be paid bears the certificate of the

2-6  [director] state controller or his authorized representative stating:

2-7    1.  That the persons named in the payroll or account have been

2-8  appointed, employed, reinstated or promoted as required by law and the

2-9  regulations established [under] pursuant to this chapter; and

2-10    2.  That the salary or compensation is within the salary or wage

2-11  schedule fixed pursuant to law.

2-12    Sec. 3.  NRS 284.200 is hereby amended to read as follows:

2-13    284.200  If the [director] state controller wrongfully withholds

2-14  certification of the payroll or account of any employee, the employee may

2-15  maintain a proceeding to compel the [director] state controller to certify

2-16  the payroll or account.
