AN ACT relating to plumbers; requiring the division of industrial relations of the department of business and industry to establish minimum standards for the education, training and certification of plumbers; authorizing the division to establish a schedule of fees for the certification of plumbers; prohibiting a person from working as a plumber unless he holds a certificate as a plumber issued by the division; prohibiting the state contractors’ board from issuing a license to, or renewing the license of, a plumber who does not hold a certificate as a plumber issued by the division; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 618 of NRS is hereby amended by adding thereto
1-2 the provisions set forth as sections 2 to 6, inclusive, of this act.
1-3 Sec. 2. The division shall adopt regulations establishing standards
1-4 for the education and training of plumbers, including, without limitation,
1-5 regulations:
1-6 1. Requiring the establishment and implementation of programs for
1-7 the education, training and certification of plumbers;
1-8 2. Requiring the annual certification of plumbers; and
1-9 3. Establishing a schedule of reasonable fees for the issuance and
1-10 renewal of a certificate as a plumber.
1-11 Sec. 3. 1. The division shall issue a certificate as a plumber to a
1-12 person who:
1-13 (a) Successfully completes the required education and training
1-14 established by the division pursuant to section 2 of this act;
2-1 (b) Pays the required fee, if any, for the issuance of the certificate;
2-2 and
2-3 (c) Complies with all other requirements established by the division
2-4 for the issuance of the certificate.
2-5 2. A person shall not work as a plumber in this state unless he holds
2-6 a certificate as a plumber issued by the division pursuant to this section.
2-7 Sec. 4. 1. An applicant for the issuance or renewal of a certificate
2-8 as a plumber shall submit with his application the statement prescribed
2-9 by the welfare division of the department of human resources pursuant to
2-10 NRS 425.520. The statement must be completed and signed by the
2-11 applicant.
2-12 2. The division of industrial relations shall include the statement
2-13 required pursuant to subsection 1 in:
2-14 (a) The application or any other forms that must be submitted for the
2-15 issuance or renewal of the certificate; or
2-16 (b) A separate form prescribed by the division.
2-17 3. The division shall not issue or renew a certificate as a plumber if
2-18 the applicant:
2-19 (a) Fails to submit the statement required pursuant to subsection 1; or
2-20 (b) Indicates on the statement submitted pursuant to subsection 1 that
2-21 he is subject to a court order for the support of a child and is not in
2-22 compliance with the order or a plan approved by the district attorney or
2-23 other public agency enforcing the order for the repayment of the amount
2-24 owed pursuant to the order.
2-25 4. If an applicant indicates on the statement submitted pursuant to
2-26 subsection 1 that he is subject to a court order for the support of a child
2-27 and is not in compliance with the order or a plan approved by the district
2-28 attorney or other public agency enforcing the order for the repayment of
2-29 the amount owed pursuant to the order, the person to whom the
2-30 application was submitted shall advise the applicant to contact the district
2-31 attorney or other public agency enforcing the order to determine the
2-32 actions that the applicant may take to satisfy the arrearage.
2-33 Sec. 5. An application for the issuance of a certificate as a plumber
2-34 pursuant to sections 2 to 6, inclusive, of this act must include the social
2-35 security number of the applicant.
2-36 Sec. 6. 1. If the division receives a copy of a court order issued
2-37 pursuant to NRS 425.540 that provides for the suspension of all
2-38 professional, occupational and recreational licenses, certificates and
2-39 permits issued to a person who holds a certificate as a plumber, the
2-40 division shall deem the certificate issued to that person to be suspended
2-41 at the end of the 30th day after the date on which the court order was
2-42 issued unless the division receives a letter issued by the district attorney
2-43 or other public agency pursuant to NRS 425.550 to the person who has
2-44 been issued the certificate stating that the person has complied with the
2-45 subpoena or warrant or has satisfied the arrearage pursuant to NRS
2-46 425.560.
2-47 2. The division shall reinstate a certificate as a plumber that has
2-48 been suspended by a district court pursuant to NRS 425.540 if the
2-49 division receives a letter issued by the district attorney or other public
3-1 agency pursuant to NRS 425.550 to the plumber whose certificate was
3-2 suspended stating that the plumber whose certificate was suspended has
3-3 complied with the subpoena or warrant or has satisfied the arrearage
3-4 pursuant to NRS 425.560.
3-5 Sec. 7. Chapter 624 of NRS is hereby amended by adding thereto a
3-6 new section to read as follows:
3-7 The board shall not issue or renew a specialty license in plumbing to
3-8 any person who does not hold a certificate as a plumber issued by the
3-9 division of industrial relations of the department of business and industry
3-10 pursuant to sections 2 to 6, inclusive, of this act.
3-11 Sec. 8. 1. This section and sections 1 and 2 of this act become
3-12 effective upon passage and approval.
3-13 2. Sections 3 to 7, inclusive, of this act become effective on July 1,
3-14 2002.
3-15 3. The provisions of sections 4, 5 and 6 of this act expire by limitation
3-16 on the date on which the provisions of 42 U.S.C. § 666 requiring each state
3-17 to establish procedures under which the state has the authority to withhold
3-18 or suspend, or to restrict the use of, professional, occupational and
3-19 recreational licenses of persons who:
3-20 (a) Have failed to comply with a subpoena or warrant relating to a
3-21 proceeding to determine the paternity of a child or to establish or enforce
3-22 an obligation for the support of a child; or
3-23 (b) Are in arrears in the payment for the support of one or more
3-24 children,
3-25 are repealed by the Congress of the United States.
