AN ACT relating to industrial insurance; providing for a prospective increase in compensation for a permanent total disability or permanent partial disability under certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 616C of NRS is hereby amended by adding thereto
1-2 a new section to read as follows:
1-3 1. In addition to any other increase in compensation for a permanent
1-4 total disability or permanent partial disability pursuant to the provisions
1-5 of chapters 616A to 616D, inclusive, of NRS, a claimant or any
1-6 dependent of a claimant who receives compensation for a permanent
1-7 total disability or permanent partial disability pursuant to those chapters
1-8 is entitled to an annual increase in his compensation in an amount that
1-9 is equal to the annual increase, if any, set forth in the Consumer Price
1-10 Index (All Items) published by the United States Department of Labor for
1-11 the year in which the index is published.
1-12 2. On or before December 15 of each year, the administrator shall
1-13 determine the amount of the increase, if any, required by this section. As
1-14 soon as practicable after making that determination, the administrator
1-15 shall:
1-16 (a) Prepare a written notice setting forth:
1-17 (1) The amount of the increase in compensation for a permanent
1-18 total disability or permanent partial disability required to be paid to
1-19 claimants for the year after the year in which he makes the
1-20 determination; or
2-1 (2) If the administrator determines that an increase in that
2-2 compensation is not required for that year, a statement indicating that
2-3 fact; and
2-4 (b) Provide the written notice to each insurer.
2-5 Sec. 2. The amount of any increase in compensation required pursuant
2-6 to section 1 of this act must not be paid for any period before January 1,
2-7 2002.
2-8 Sec. 3. This act becomes effective on July 1, 2001.
