AN ACT relating to cooperative agreements; prohibiting the operation of an entity created by cooperative agreement between public agencies in such a manner as to affect adversely the continued existence of a public agency that is not a party to the agreement; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 277.130 is hereby amended to read as follows:

1-2    277.130  1.  No agreement made pursuant to NRS 277.080 to 277.170,

1-3  inclusive, [shall relieve] relieves any public agency of any obligation or

1-4  responsibility imposed upon it by law except that to the extent of actual

1-5  and timely performance by a joint board or other legal or administrative

1-6  entity created by the agreement, such performance may be offered in

1-7  satisfaction of the obligation or responsibility.

1-8    2.  A legal entity created by an agreement made pursuant to NRS

1-9  277.080 to 277.170, inclusive, must not be operated in such a manner as

1-10  to affect adversely the continued existence of a public agency that is not a

1-11  party to the agreement.
