AN ACT relating to the state public works board; authorizing the removal of the manager of the board under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 341.100 is hereby amended to read as follows:

1-2    341.100  1.  The board may appoint a manager[.] who serves at the

1-3  pleasure of the board and the governor. The board or the governor may

1-4  remove the manager for inefficiency, neglect of duty, malfeasance or for

1-5  other just cause.

1-6    2.  The manager, with the approval of the board, may appoint a deputy

1-7  for professional services and a deputy for administrative, fiscal and

1-8  constructional services. In addition, the manager may appoint such other

1-9  technical and clerical assistants as may be necessary to carry into effect the

1-10  provisions of this chapter.

1-11    [2.] 3.  The manager and his deputies are in the unclassified service of

1-12  the state. Except as otherwise provided in NRS 284.143, the manager and

1-13  each deputy shall devote his entire time and attention to the business of his

1-14  office and shall not pursue any other business or occupation or hold any

1-15  other office of profit.


2-1    [3.] 4.  The manager and his deputy for professional services must

2-2  each be a licensed professional engineer pursuant to the provisions of

2-3  chapter 625 of NRS or an architect registered pursuant to the provisions of

2-4  chapter 623 of NRS. The deputy manager for administrative, fiscal and

2-5  constructional services must have a comprehensive knowledge of

2-6  principles of administration and a working knowledge of principles of

2-7  engineering or architecture as determined by the board.

2-8    [4.] 5.  The manager shall:

2-9    (a) Serve as the secretary of the board.

2-10    (b) Manage the daily affairs of the board.

2-11    (c) Represent the board before the legislature.

2-12    (d) Prepare and submit to the board, for its approval, the recommended

2-13  priority for proposed capital improvement projects and provide the board

2-14  with an estimate of the cost of each project.

2-15    (e) Make recommendations to the board for the selection of architects,

2-16  engineers and contractors.

2-17    (f) Make recommendations to the board concerning the acceptance of

2-18  completed projects.

2-19    (g) Advise the board and the legislature, or the interim finance

2-20  committee if the legislature is not in session, on a monthly basis of the

2-21  progress of all public works projects which are a part of the approved

2-22  capital improvement program.

2-23    Sec. 2.  This act becomes effective upon passage and approval.
