AN ACT relating to health care; requiring an external review organization to be certified by the commissioner of insurance before conducting an external review of a final adverse determination of a managed care organization or health maintenance organization; authorizing an insured under certain health care plans to submit to a managed care organization or health maintenance organization a request for such a review under certain circumstances; requiring an external review organization to approve, modify or reverse a final adverse determination within a certain period; providing that an external review organization is not liable in a civil action for damages relating to a determination issued by the external review organization under certain circumstances; requiring the director of the office for consumer health assistance to contract with certain external review organizations; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 683A of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. An external review organization shall not conduct an external
1-4 review of a final adverse determination pursuant to sections 4 to 12,
1-5 inclusive, of this act unless it is certified in accordance with regulations
1-6 adopted by the commissioner. The regulations must include, without
1-7 limitation, provisions setting forth:
1-8 (a) The manner in which an external review organization may apply
1-9 for a certificate and the requirements for the issuance and renewal of the
1-10 certificate pursuant to this section;
2-1 (b) The grounds for which the commissioner may refuse to issue,
2-2 suspend, revoke or refuse to renew a certificate issued pursuant to this
2-3 section; and
2-4 (c) The manner and circumstances under which an external review
2-5 organization is required to conduct its business.
2-6 2. The regulations must include provisions for issuing a certificate
2-7 specified in subsection 1 to an external review organization that submits
2-8 evidence satisfactory to the commissioner that the external review
2-9 organization is certified to conduct external reviews of final adverse
2-10 determinations by the National Committee for Quality Assurance, the
2-11 American Accreditation Health Care Commission or any other
2-12 nationally recognized organization approved by the commissioner.
2-13 3. A certificate issued pursuant to this section expires 1 year after it
2-14 is issued and may be renewed in accordance with regulations adopted by
2-15 the commissioner.
2-16 4. The commissioner shall ensure that each external review
2-17 organization which is certified pursuant to this section:
2-18 (a) Uses only clinical peers to conduct external reviews;
2-19 (b) Is not a subsidiary of, or owned or controlled by, a health plan, a
2-20 trade association of health plans or a professional association of health
2-21 care providers; and
2-22 (c) Complies with the provisions of this section and sections 4 to 12,
2-23 inclusive, of this act and any regulations adopted by the commissioner
2-24 pursuant to those sections.
2-25 5. The commissioner shall ensure that an external review
2-26 organization that is certified pursuant to this section or any clinical peer
2-27 who conducts or participates in an external review for the external
2-28 review organization, or any member of his immediate family, does not
2-29 have afinancial interest in:
2-30 (a) A managed care organization that submits a final adverse
2-31 determination to the external review organization pursuant to sections 4
2-32 to 12, inclusive, of this act or any officer, director or manager of the
2-33 managed care organization; or
2-34 (b) The medical group of a physician or any organization that
2-35 provides health care services to an insured under a health care plan for
2-36 which a final adverse determination is made.
2-37 6. The commissioner may charge and collect a fee for issuing or
2-38 renewing a certificate of an external review organization pursuant to this
2-39 section. The fee must not exceed the cost of issuing or renewing the
2-40 certificate.
2-41 7. The commissioner shall annually prepare and make available to
2-42 the general public a list that includes the name of each external review
2-43 organization which is issued a certificate or whose certificate is renewed
2-44 pursuant to this section during the year immediately preceding the year
2-45 in which the commissioner prepares the list.
2-46 8. As used in this section:
2-47 (a) “Clinical peer” has the meaning ascribed to it in section 5 of this
2-48 act.
3-1 (b) “External review organization” has the meaning ascribed to it in
3-2 section 6 of this act.
3-3 (c) “Final adverse determination” has the meaning ascribed to it in
3-4 section 7 of this act.
3-5 Sec. 2. NRS 695C.260 is hereby amended to read as follows:
3-6 695C.260 [Every] Each health maintenance organization shall
3-7 establish [a] :
3-8 1. A complaint system which complies with the provisions of NRS
3-9 695G.200 to 695G.230, inclusive[.] ; and
3-10 2. A system for conducting external reviews of final adverse
3-11 determinations that complies with the provisions of sections 4 to 12,
3-12 inclusive, of this act.
3-13 Sec. 3. Chapter 695G of NRS is hereby amended by adding thereto
3-14 the provisions set forth as sections 4 to 12, inclusive, of this act.
3-15 Sec. 4. “Authorized representative” means a person who has
3-16 obtained the consent of an insured to represent him in an external review
3-17 of a final adverse determination conducted pursuant to sections 4 to 12,
3-18 inclusive, of this act.
3-19 Sec. 5. “Clinical peer” means a physician who is:
3-20 1. Engaged in the practice of medicine;
3-21 2. Licensed pursuant to the provisions of chapter 630 or 633 of NRS;
3-22 and
3-23 3. Certified or is eligible for certification by the board of medical
3-24 examiners in the same or similar area of practice as is the health care
3-25 service that is the subject of a final adverse determination.
3-26 Sec. 6. “External review organization” means an organization that:
3-27 1. Conducts an external review of a final adverse determination;
3-28 2. Is certified by the commissioner in accordance with section 1 of
3-29 this act; and
3-30 3. Has contracted with the director of the office for consumer health
3-31 assistance to conduct external reviews of final adverse determinations
3-32 pursuant to subsection 8 of NRS 223.560.
3-33 Sec. 7. “Final adverse determination” means a final decision of a
3-34 managed care organization to deny, reduce or terminate coverage for
3-35 health care services or to deny payment for those services concerning a
3-36 complaint filed pursuant to NRS 695G.200 because the health care
3-37 services were determined to be:
3-38 1. Medically unnecessary;
3-39 2. Not covered under the health care plan of the insured;
3-40 3. Experimental or investigational; or
3-41 4. Provided by a provider of health care who was chosen by the
3-42 insured in violation of the terms and conditions of his health care
plan.
3-43 The term does not include a determination relating to a claim for
3-44 workers’ compensation pursuant to chapters 616A to 617, inclusive, of
3-45 NRS.
3-46 Sec. 8. “Life-threatening condition” means a disease or other
3-47 medical condition with respect to which death is probable unless the
3-48 course of the disease or medical condition is interrupted.
4-1 Sec. 9. 1. If an insured or a physician of an insured receives notice
4-2 of a final adverse determination from a managed care organization
4-3 concerning the insured, and if the insured is required to pay $500 or
4-4 more for the health care services that are the subject of the final adverse
4-5 determination, the insured, the physician of the insured or an authorized
4-6 representative may, within 90 days after receiving notice of the final
4-7 adverse determination, submit a request to the managed care
4-8 organization for an external review of the final adverse determination.
4-9 2. Within 3 days after receiving a request pursuant to subsection 1,
4-10 the managed care organization shall:
4-11 (a) Notify the insured, his authorized representative or his physician,
4-12 the agent who performed utilization review for the managed care
4-13 organization, if any, and the office for consumer health assistance that
4-14 the request has been filed with the managed care organization; and
4-15 (b) Provide to an external review organization all documents and
4-16 materials relating to the final adverse determination, including, without
4-17 limitation:
4-18 (1) Any medical records of the insured relating to the external
4-19 review;
4-20 (2) A copy of the provisions of the health care plan upon which the
4-21 final adverse determination was based;
4-22 (3) Any documents used by the managed care organization to make
4-23 the final adverse determination;
4-24 (4) The reasons for the final adverse determination; and
4-25 (5) Insofar as practicable, a list that specifies each provider of
4-26 health care who has provided health care to the insured and the medical
4-27 records of the provider of health care relating to the external review.
4-28 Sec. 10. 1. Upon receipt of a request for an external review
4-29 pursuant to section 9 of this act, the external review organization shall,
4-30 within 5 days after receiving the request:
4-31 (a) Review the request and the documents and materials submitted
4-32 pursuant to section 9 of this act; and
4-33 (b) Notify the insured, his physician and the managed care
4-34 organization if any additional information is required to conduct a
4-35 review of the final adverse determination.
4-36 2. Except as otherwise provided in subsection 3, the external review
4-37 organization shall approve, modify or reverse the final adverse
4-38 determination within 15 days after it receives the information required to
4-39 make that determination pursuant to this section, but in no case later
4-40 than 20 days after the external review organization receives the request
4-41 for an external review. The external review organization shall submit a
4-42 copy of its determination, including the reasons therefor, to:
4-43 (a) The insured;
4-44 (b) The physician of the insured;
4-45 (c) The authorized representative of the insured, if any;
4-46 (d) The managed care organization; and
4-47 (e) The director of the office for consumer health assistance.
4-48 3. If the insured who submitted the request for an external review
4-49 has a life-threatening condition, the external review organization shall
5-1 approve, modify or reverse the final adverse determination as soon as
5-2 practicable, but not later than 72 hours after it receives the request for
5-3 review.
5-4 4. If the issue concerning the external review is whether the health
5-5 care services are covered under the terms and conditions of the health
5-6 care plan of the insured, the external review organization shall notify the
5-7 commissioner of that fact as soon as practicable after receiving the
5-8 request for an external review. Upon receipt of the information required
5-9 to make the determination, the commissioner shall:
5-10 (a) Issue a determination concerning that benefit within the periods
5-11 prescribed in this section; and
5-12 (b) Submit the results of his determination to each person specified in
5-13 subsection 2.
5-14 5. In making a determination pursuant to this section, an external
5-15 review organization or any clinical peer who conducts or participates in
5-16 an external review of a final adverse determination for the external
5-17 review organization shall consider, without limitation:
5-18 (a) The medical records of the insured;
5-19 (b) Any recommendations of the physician of the insured;
5-20 (c) Any generally accepted medical guidelines, including guidelines
5-21 established by the Federal Government or any national or professional
5-22 society, board or association that establishes such guidelines approved by
5-23 the commissioner; and
5-24 (d) Any applicable criteria relating to adverse final determinations
5-25 established and used by the managed care organization or the agent it
5-26 designates to perform utilization review.
5-27 Sec. 11. 1. A determination issued by an external review
5-28 organization pursuant to sections 4 to 12, inclusive, of this act is binding
5-29 upon the managed care organization and the insured except to the extent
5-30 that the insured has other remedies pursuant to any federal or state law.
5-31 2. An external review organization or any clinical peer who conducts
5-32 or participates in an external review of a final adverse determination for
5-33 the external review organization is not liable in a civil action for
5-34 damages relating to a determination made by the external review
5-35 organization if the determination is made in good faith and without gross
5-36 negligence.
5-37 3. The cost of conducting an external review of a final adverse
5-38 determination pursuant to sections 4 to 12, inclusive, of this act must be
5-39 paid to the office for consumer assistance by the managed care
5-40 organization that made the final adverse determination.
5-41 Sec. 12. In lieu of resolving a complaint of an insured in accordance
5-42 with a system for resolving complaints established pursuant to the
5-43 provisions of NRS 695G.200, a managed care organization may:
5-44 1. Submit the complaint to an external review organization pursuant
5-45 to the provisions of sections 4 to 12, inclusive, of this act; or
5-46 2. If a federal law or regulation provides a procedure for submitting
5-47 the complaint for resolution that the commissioner determines is
5-48 substantially similar to the procedure for submitting the complaint to an
5-49 external review organization pursuant to sections 4 to 12, inclusive, of
6-1 this act, submit the complaint for resolution in accordance with the
6-2 federal law or regulation.
6-3 Sec. 13. NRS 695G.010 is hereby amended to read as follows:
6-4 695G.010 As used in this chapter, unless the context otherwise
6-5 requires, the words and terms defined in NRS 695G.020 to 695G.080,
6-6 inclusive, and sections 4 to 8, inclusive, of this act have the meanings
6-7 ascribed to them in those sections.
6-8 Sec. 14. NRS 695G.210 is hereby amended to read as follows:
6-9 695G.210 1. [A] Except as otherwise provided in section 12 of this
6-10 act, a system for resolving complaints created pursuant to NRS 695G.200
6-11 must include, without limitation, an initial investigation, a review of the
6-12 complaint by a review board and a procedure for appealing a determination
6-13 regarding the complaint. The majority of the members of the review board
6-14 must be insureds who receive health care services from the managed care
6-15 organization.
6-16 2. Except as otherwise provided in subsection 3, a review board shall
6-17 complete its review regarding a complaint or appeal and notify the insured
6-18 of its determination not later than 30 days after the complaint or appeal is
6-19 filed, unless the insured and the review board have agreed to a longer
6-20 period . [of time.]
6-21 3. If a complaint involves an imminent and serious threat to the health
6-22 of the insured, the managed care organization shall inform the insured
6-23 immediately of his right to an expedited review of his complaint. If an
6-24 expedited review is required, the review board shall notify the insured in
6-25 writing of its determination within 72 hours after the complaint is filed.
6-26 4. Notice provided to an insured by a review board regarding a
6-27 complaint must include, without limitation, an explanation of any further
6-28 rights of the insured regarding the complaint that are available under his
6-29 health care plan.
6-30 Sec. 15. NRS 695G.230 is hereby amended to read as follows:
6-31 695G.230 1. [Following] After approval by the commissioner, each
6-32 managed care organization shall provide a written notice to an insured, in
6-33 clear and comprehensible language that is understandable to an ordinary
6-34 layperson, explaining the right of the insured to file a written complaint
6-35 and to obtain an expedited review pursuant to NRS 695G.210. Such a
6-36 notice must be provided to an insured:
6-37 (a) At the time he receives his certificate of coverage or evidence of
6-38 coverage;
6-39 (b) Any time that the managed care organization denies coverage of a
6-40 health care service or limits coverage of a health care service to an insured;
6-41 and
6-42 (c) Any other time deemed necessary by the commissioner.
6-43 2. [Any time that] If a managed care organization denies coverage of a
6-44 health care service to an insured, including, without limitation, a health
6-45 maintenance organization that denies a claim related to a health care plan
6-46 pursuant to NRS 695C.185, it shall notify the insured in writing within 10
6-47 working days after it denies coverage of the health care service of:
6-48 (a) The reason for denying coverage of the service;
7-1 (b) The criteria by which the managed care organization or insurer
7-2 determines whether to authorize or deny coverage of the health care
7-3 service; and
7-4 (c) His right to [file] :
7-5 (1) File a written complaint and the procedure for filing such a
7-6 complaint[.] ;
7-7 (2) Appeal a final adverse determination pursuant to sections 4 to
7-8 12, inclusive, of this act;
7-9 (3) Receive an expedited external review of a final adverse
7-10 determination if he has a life-threatening condition, including
7-11 notification of the procedure for requesting the expedited external
7-12 review;
7-13 (4) Receive assistance from any person, including an attorney, for
7-14 an external review of a final adverse determination; and
7-15 (5) Appear before any external review organization to which he has
7-16 appealed a final adverse determination and submit any evidence to that
7-17 external review organization relating to the final adverse determination.
7-18 3. A written notice which is approved by the commissioner shall be
7-19 deemed to be in clear and comprehensible language that is understandable
7-20 to an ordinary layperson.
7-21 Sec. 16. NRS 223.560 is hereby amended to read as follows:
7-22 223.560 The director shall:
7-23 1. Respond to written and telephonic inquiries received from
7-24 consumers and injured employees regarding concerns and problems related
7-25 to health care and workers’ compensation;
7-26 2. Assist consumers and injured employees in understanding their
7-27 rights and responsibilities under health care plans and policies of industrial
7-28 insurance;
7-29 3. Identify and investigate complaints of consumers and injured
7-30 employees regarding their health care plans and policies of industrial
7-31 insurance and assist those consumers and injured employees to resolve
7-32 their complaints, including, without limitation:
7-33 (a) Referring consumers and injured employees to the appropriate
7-34 agency, department or other entity that is responsible for addressing the
7-35 specific complaint of the consumer or injured employee; and
7-36 (b) Providing counseling and assistance to consumers and injured
7-37 employees concerning health care plans and policies of industrial
7-38 insurance;
7-39 4. Provide information to consumers and injured employees
7-40 concerning health care plans and policies of industrial insurance in this
7-41 state;
7-42 5. Establish and maintain a system to collect and maintain information
7-43 pertaining to the written and telephonic inquiries received by the office;
7-44 6. Take such actions as are necessary to ensure public awareness of the
7-45 existence and purpose of the services provided by the director pursuant to
7-46 this section; [and]
7-47 7. In appropriate cases and pursuant to the direction of the governor,
7-48 refer a complaint or the results of an investigation to the attorney general
7-49 for further action[.] ; and
8-1 8. On or before January 1 of each year, and in accordance with
8-2 regulations adopted by the commissioner of insurance, contract with an
8-3 external review organization that is certified by the commissioner of
8-4 insurance pursuant to section 1 of this act to conduct external reviews of
8-5 final adverse determinations in accordance with the provisions of
8-6 sections 4 to 12, inclusive, of this act. A contract entered into pursuant to
8-7 this subsection may be renewed by the director.
8-8 Sec. 17. NRS 223.580 is hereby amended to read as follows:
8-9 223.580 On or before February 1 of each year, the director shall
8-10 submit a written report to the governor, and to the director of the legislative
8-11 counsel bureau for transmittal to the appropriate committee or committees
8-12 of the legislature. The report must include, without limitation:
8-13 1. A statement setting forth the number and geographic origin of the
8-14 written and telephonic inquiries received by the office and the issues to
8-15 which those inquiries were related;
8-16 2. A statement setting forth the type of assistance provided to each
8-17 consumer and injured employee who sought assistance from the director,
8-18 including, without limitation, the number of referrals made to the attorney
8-19 general pursuant to subsection 7 of NRS 223.560; [and]
8-20 3. A statement setting forth the disposition of each inquiry and
8-21 complaint received by the director[.] ; and
8-22 4. A statement setting forth the number of external reviews
8-23 conducted by external review organizations pursuant to sections 4 to 12,
8-24 inclusive, of this act and the disposition of each of those reviews.
8-25 Sec. 18. This act becomes effective upon passage and approval for the
8-26 purpose of adopting regulations by the commissioner of insurance to carry
8-27 out the provisions of this act and on July 1, 2002, for all other purposes.
