AN ACT relating to railroad trains; requiring the Nevada gaming commission to adopt regulations governing the licensing and operation of railroad gaming; making an appropriation to White Pine County for the repair of certain trains and the purchase and renovation of certain track; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 463 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  The commission shall, with the advice and assistance of the board,

1-4  adopt regulations governing the licensing and operation of railroad

1-5  gaming.

1-6    2.  Notwithstanding any other provision of law:

1-7    (a) The commission may issue a nonrestricted license to a person to

1-8  operate railroad gaming in accordance with the regulations adopted

1-9  pursuant to this section.

1-10    (b) To operate railroad gaming, a person is not required to procure or

1-11  maintain:

1-12      (1) A gaming license or business license from any city, town or

1-13  county, regardless of whether the railroad train stops in or traverses that

1-14  city, town or county; or

1-15      (2) A county license for each particular device or game or slot

1-16  machine.

1-17    (c) No city, town or county may collect any license fee or tax for the

1-18  operation of railroad gaming.


2-1    3.  As used in this section:

2-2    (a) “Railroad gaming” means the conduct of gambling games on a

2-3  railroad train.

2-4    (b) “Railroad train” means a steam, electric or other motor engine,

2-5  with or without cars coupled thereto, operated upon stationary rails. The

2-6  term does not include a streetcar.

2-7    Sec. 2.  There is hereby appropriated from the state general fund to

2-8  White Pine County the sum of $2,000,000 for the repair of the two steam

2-9  locomotives used on the Nevada Northern Railroad, the replacement of the

2-10  wye switch, and the purchase and renovation of the Nevada Northern

2-11  Track.

2-12    Sec. 3.  Any remaining balance of the appropriation made by section 2

2-13  of this act must not be committed for expenditure after June 30, 2005, and

2-14  reverts to the state general fund as soon as all payments of money

2-15  committed have been made.

2-16    Sec. 4.  This act becomes effective upon passage and approval.
