AN ACT relating to education; making an appropriation for allocation to school districts for the purchase of textbooks and workbooks; making an appropriation for allocation to school districts for the purchase of textbooks and for professional development and educational technology; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. 1.  There is hereby appropriated from the state general

1-2  fund to the Department of Education for allocation by the Superintendent

1-3  of Public Instruction to school districts for the purchase of textbooks and

1-4  workbooks the sum of $12,000,000.

1-5    2.  On or before December 1, 2001, the board of trustees of a school

1-6  district may submit an application to the Department of Education. The

1-7  application must include, without limitation, a plan that sets forth the

1-8  manner in which the school district will use the money to:

1-9    (a) Eliminate the use of shared classroom book sets in the public

1-10  schools within the school district which must remain in the classroom; and

1-11    (b) Provide each pupil enrolled in a public school of the school district

1-12  with a textbook for each class in which a textbook is used and an


2-1  accompanying workbook, if applicable, that the pupil may use at home for

2-2  educational purposes.

2-3  The plan must include a detailed description of the grade levels and subject

2-4  areas for which the textbooks and workbooks will be purchased for use in

2-5  the school years 2002-2003, 2003-2004, 2004-2005 and 2005-2006.

2-6    3.  Upon receipt of an application pursuant to subsection 2, the

2-7  Department of Education shall review the application and make

2-8  recommendations jointly with the Budget Division of the Department of

2-9  Administration and the Legislative Bureau of Educational Accountability

2-10  and Program Evaluation. The joint recommendation of the amount of the

2-11  allocation must be transmitted to the Superintendent of Public Instruction

2-12  for his consideration before making his determinations pursuant to

2-13  subsection 4. The Superintendent of Public Instruction is not bound to

2-14  follow the joint recommendation.

2-15    4.  The Superintendent of Public Instruction shall determine the total

2-16  amount of the allocation that a school district will receive for the purchase

2-17  of textbooks and workbooks for use in the school years 2002-2003, 2003-

2-18  2004, 2004-2005 and 2005-2006. After the Superintendent of Public

2-19  Instruction determines the total amount of the allocation for a school

2-20  district, the Department of Education shall:

2-21    (a) On or before April 1, 2002, apportion the first allocation to the

2-22  school district for the purchase of textbooks and workbooks for use in the

2-23  school year 2002-2003.

2-24    (b) On or before January 1, 2003, apportion the second allocation to the

2-25  school district for the purchase of textbooks and workbooks for use in the

2-26  school year 2003-2004.

2-27    (c) On or before January 1, 2004, apportion the third allocation to the

2-28  school district for the purchase of textbooks and workbooks for use in the

2-29  school year 2004-2005.

2-30    (d) On or before January 1, 2005, apportion the fourth allocation to the

2-31  school district for the purchase of textbooks and workbooks for use in the

2-32  school year 2005-2006.

2-33    5.  A school district that receives an allocation of money pursuant to

2-34  this section shall use the money for each school year that the school district

2-35  receives an allocation to:

2-36    (a) Purchase a sufficient number of textbooks and accompanying

2-37  workbooks, if applicable, to eliminate the use of classroom book sets and

2-38  to provide each pupil enrolled in a public school of the school district with

2-39  a textbook for each class in which a textbook is used and an accompanying

2-40  workbook that the pupil may take home for educational purposes.

2-41    (b) Supplement and not replace the amount of money that the school

2-42  district would otherwise expend for the purchase of textbooks and

2-43  workbooks.

2-44  Notwithstanding the provisions of NRS 387.207 to the contrary, a school

2-45  district that receives an allocation of money pursuant to this section shall

2-46  expend for the purchase of textbooks and workbooks for each school year

2-47  that it receives an allocation an amount of money that is at least equal to

2-48  the average amount of money that was expended per pupil by the school

2-49  district in the school year immediately preceding the school year for which


3-1  the allocation is made for the purchase of textbooks and workbooks, not

3-2  including the amount of money received from a previous allocation

3-3  pursuant to this section.

3-4    6.  The Department of Education shall submit a written report setting

3-5  forth the uses of the money by school districts that received allocations and

3-6  evaluating the effectiveness of those uses in eliminating the use of

3-7  classroom book sets in schools. The written report must be submitted to the

3-8  Director of the Legislative Counsel Bureau:

3-9    (a) On or before February 1, 2003, and February 1, 2005, for

3-10  transmission to the Nevada Legislature; and

3-11    (b) On or before February 1, 2004, for transmission to the Legislative

3-12  Committee on Education created pursuant to NRS 218.5352.

3-13    7.  Before a school district amends a plan for expenditure of an

3-14  allocation of money received pursuant to this section, the school district

3-15  must submit the proposed amendment to the Department of Education to

3-16  receive:

3-17    (a) Joint approval from the Department of Education, the Budget

3-18  Division of the Department of Administration and the Legislative Bureau

3-19  of Educational Accountability and Program Evaluation; or

3-20    (b) Approval from the Superintendent of Public Instruction.

3-21    8.  If the Superintendent of Public Instruction determines that the

3-22  combined total amount of the allocations to the school districts in this state

3-23  pursuant to this section to eliminate the use of classroom book sets and to

3-24  provide each pupil with a textbook and workbook is less than $12,000,000,

3-25  he shall notify each school district that money remains available from the

3-26  appropriation made by subsection 1. Upon receipt of such notice, a school

3-27  district may submit an additional application to the Department of

3-28  Education. Such an application must be reviewed in accordance with

3-29  subsection 3. The Superintendent of Public Instruction shall determine the

3-30  total amount of the additional allocation that a school district receives. A

3-31  school district that receives an additional allocation pursuant to this

3-32  subsection shall use the money:

3-33    (a) To purchase textbooks and workbooks, including, without

3-34  limitation, electronic textbooks, library books and other instructional

3-35  materials.

3-36    (b) To provide for the professional development of teachers employed

3-37  by the school district, including, without limitation, training to address the

3-38  needs of teachers in incorporating educational technology in the classroom

3-39  and training to enable teachers to instruct pupils in the use of educational

3-40  technology. The professional development provided pursuant to this

3-41  paragraph must be in addition to the professional development provided

3-42  through the regional training programs for the professional development of

3-43  teachers and administrators established pursuant to section 16 of chapter

3-44  559, Statutes of Nevada 1999, at page 2930.

3-45    (c) For educational technology.

3-46  The money must be used by the school district to supplement and not

3-47  replace the amount of money that the school district would otherwise

3-48  expend for the purposes set forth in paragraphs (a), (b) and (c).


4-1    9.  Any remaining balance of the appropriation made by subsection 1

4-2  must not be committed for expenditure after June 30, 2005, and reverts to

4-3  the state general fund as soon as all payments of money committed have

4-4  been made.

4-5    Sec. 2.  1.  There is hereby appropriated from the state general fund

4-6  to the Department of Education the sum of $8,000,000 for allocation by the

4-7  Superintendent of Public Instruction to school districts to purchase

4-8  textbooks and other instructional materials, provide for the professional

4-9  development of teachers and for educational technology.

4-10    2.  On or before December 1, 2001, the board of trustees of a school

4-11  district may submit an application to the Department of Education. The

4-12  application must include, without limitation, a plan that sets forth the

4-13  manner in which the school district will use the money, including, without

4-14  limitation, a detailed description of the manner in which the money will be

4-15  used for the school years 2002-2003 and 2003-2004.

4-16    3.  Upon receipt of an application pursuant to subsection 2, the

4-17  Department of Education shall review the application and make

4-18  recommendations jointly with the Budget Division of the Department of

4-19  Administration and the Legislative Bureau of Educational Accountability

4-20  and Program Evaluation. The joint recommendation of the amount of the

4-21  allocation must be transmitted to the Superintendent of Public Instruction

4-22  for his consideration before making his determinations pursuant to

4-23  subsection 4. The Superintendent of Public Instruction is not bound to

4-25    4.  The Superintendent of Public Instruction shall determine the total

4-26  amount of the allocation that a school district will receive for use in the

4-27  school years 2002-2003 and 2003-2004. After the Superintendent of Public

4-28  Instruction determines the total amount of the allocation for a school

4-29  district, the Department of Education shall:

4-30    (a) On or before April 1, 2002, apportion the first allocation to the

4-31  school district for use in the school year 2002-2003.

4-32    (b) On or before January 1, 2003, apportion the second allocation to the

4-33  school district for use in the school year 2003-2004.

4-34    5.  A school district that receives an allocation of money pursuant to

4-36    (a) To purchase textbooks and workbooks, including, without

4-38  materials. The textbooks and workbooks purchased pursuant to this

4-39  paragraph may be purchased to eliminate the use of classroom book sets in

4-40  public schools within the school district.

4-41    (b) To provide for the professional development of teachers employed

4-42  by the school district, including, without limitation, training to address the

4-43  needs of teachers in incorporating educational technology in the classroom

4-44  and training to enable teachers to instruct pupils in the use of educational

4-45  technology. The professional development provided pursuant to this

4-46  paragraph must be in addition to the professional development provided

4-47  through the regional training programs for the professional development of

4-48  teachers and administrators established pursuant to section 16 of chapter

4-49  559, Statutes of Nevada 1999, at page 2930.


5-1    (c) For educational technology.

5-2  The money must be used by the school district to supplement and not

5-3  replace the amount of money that the school district would otherwise

5-4  expend for the purposes set forth in paragraphs (a), (b) and (c).

5-5    6.  The Department of Education shall submit a written report setting

5-6  forth the uses of the money by school districts that received an allocation.

5-7  The written report must be submitted to the Director of the Legislative

5-8  Counsel Bureau:

5-9    (a) On or before February 1, 2003, for transmission to the Nevada

5-10  Legislature; and

5-11    (b) On or before February 1, 2004, for transmission to the Legislative

5-12  Committee on Education created pursuant to NRS 218.5352.

5-13    7.  Before a school district amends a plan for expenditure of an

5-14  allocation of money received pursuant to this section, the school district

5-15  must submit the proposed amendment to the Department of Education to

5-16  receive:

5-17    (a) Joint approval from the Department of Education, the Budget

5-18  Division of the Department of Administration and the Legislative Bureau

5-19  of Educational Accountability and Program Evaluation; or
