AN ACT relating to local governments; authorizing counties and cities to donate real property to certain nonprofit organizations in certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 244.284 is hereby amended to read as follows:
1-2 244.284 1. In addition to the powers conferred by NRS 450.500, the
1-3 board of county commissioners may [lease] :
1-4 (a) Lease any of the real property of the county for a term not exceeding
1-5 30 years[,] ; or
1-6 (b) Convey any of the real property of the county without
1-7 consideration,
1-8 if such real property is not needed for the public purposes of the county and
1-9 is [let to or for] leased or conveyed to any nonprofit charitable or civic
1-10 organization, and the property is actually used for charitable or civic
1-11 purposes.
1-12 2. A lease or conveyance pursuant to this section may be made on
1-13 such terms and conditions as seem proper to the board of county
1-14 commissioners.
1-15 3. If an organization to which property is conveyed pursuant to this
1-16 section ceases to use the property for charitable or civic purposes, the
1-17 property automatically reverts to the county.
2-1 Sec. 2. Chapter 268 of NRS is hereby amended by adding thereto a
2-2 new section to read as follows:
2-3 1. The governing body of a city may convey real property of the city
2-4 without consideration to a nonprofit charitable or civic organization if
2-5 the property is not needed for the public purposes of the city and the
2-6 property is actually used for charitable or civic purposes.
2-7 2. A conveyance pursuant to this section may be made on such terms
2-8 and conditions as seem proper to the governing body of the city.
2-9 3. If an organization to which property is conveyed pursuant to this
2-10 section ceases to use the property for charitable or civic purposes, the
2-11 property automatically reverts to the city.
2-12 Sec. 3. This act becomes effective upon passage and approval.
