AN ACT relating to local governments; authorizing counties and cities to donate real property to corporations for public benefit in certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 244.284 is hereby amended to read as follows:
1-2 244.284 1. In addition to the powers conferred by NRS 450.500, the
1-3 board of county commissioners may [lease] :
1-4 (a) Lease any of the real property of the county for a term not exceeding
1-5 30 years[,] ; or
1-6 (b) Convey any of the real property of the county, except property of
1-7 the county that is operated or occupied by the county fair and recreation
1-8 board, without consideration,
1-9 if such real property is not needed for the public purposes of the county and
1-10 is [let to or for any nonprofit charitable or civic organization,] leased or
1-11 conveyed to a corporation for public benefit,and the property is actually
1-12 used for charitable or civic purposes.
1-13 2. A lease or conveyance pursuant to this section may be made on
1-14 such terms and conditions as seem proper to the board of county
1-15 commissioners.
1-16 3. If a corporation for public benefit to which property is conveyed
1-17 pursuant to this section ceases to use the property for charitable or civic
1-18 purposes, the property automatically reverts to the county.
2-1 4. As used in this section, “corporation for public benefit” has the
2-2 meaning ascribed to it in NRS 82.021.
2-3 Sec. 2. Chapter 268 of NRS is hereby amended by adding thereto a
2-4 new section to read as follows:
2-5 1. The governing body of a city may convey real property of the city
2-6 without consideration to a corporation for public benefit if the property is
2-7 not needed for the public purposes of the city and the property is actually
2-8 used for charitable or civic purposes.
2-9 2. A conveyance pursuant to this section may be made on such terms
2-10 and conditions as seem proper to the governing body of the city.
2-11 3. If a corporation for public benefit to which property is conveyed
2-12 pursuant to this section ceases to use the property for charitable or civic
2-13 purposes, the property automatically reverts to the city.
2-14 4. As used in this section, “corporation for public benefit” has the
2-15 meaning ascribed to it in NRS 82.021.
2-16 Sec. 3. This act becomes effective upon passage and approval.
