AN ACT relating to animals; clarifying that certain provisions related to riding horses in public places do not apply to police officers while performing their official duties under certain circumstances; revising the definition of “police animal” for provisions concerning cruelty to animals to include an animal which is used, but not owned, by a governmental agency; providing penalties; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1.  NRS 202.530 is hereby amended to read as follows:

1-2    202.530  [Every person shall be]

1-3    1.  Except as otherwise provided in subsection 2, a person is guilty of

1-4  a misdemeanor who [shall:

1-5    1.  Ride or drive] :

1-6    (a) Rides or drives a horse upon a public street or highway in a manner

1-7  likely to endanger the safety or life of another person on [such] the public

1-8  street or highway.

1-9    [2.] (b) While riding or driving a horse upon a public street or highway,

1-10  [create or participate] creates or participates in any noise, disturbance or

1-11  other demonstration calculated or intended to frighten, intimidate or disturb

1-12  any person.

1-13    2.  The provisions of this section do not apply to a peace officer who

1-14  rides or drives a horse while performing his duties as a peace officer if

1-15  he:

1-16    (a) Is responding to an emergency call or is in pursuit of a suspected

1-17  violator of the law; or

1-18    (b) Determines that noncompliance with any such provision is

1-19  necessary to carry out his duties.

 


2-1    Sec. 2.  NRS 484.331 is hereby amended to read as follows:

2-2    484.331  1.  Where sidewalks are provided , it [shall be] is unlawful

2-3  for any pedestrian to walk along and upon an adjacent highway.

2-4    2.  Pedestrians walking along highways where sidewalks are not

2-5  provided shall walk on the left side of [such] those highways facing the

2-6  approaching traffic.

2-7    3.  A person shall not stand in a highway to solicit a ride or any

2-8  business from the driver or any occupant of a vehicle. A person shall not,

2-9  without a permit issued pursuant to NRS 244.3555 or 268.423, solicit any

2-10  contribution from the driver or any occupant of a vehicle.

2-11    4.  It is unlawful for any pedestrian who is under the influence of

2-12  intoxicating liquors or any narcotic or stupefying drug to be within the

2-13  traveled portion of any highway.

2-14    5.  The provisions of this section apply [also] to riders of animals[.] ,

2-15  except that the provisions of subsections 1, 2 and 3 do not apply to a

2-16  peace officer who rides an animal while performing his duties as a peace

2-17  officer.

2-18    6.  A person who violates the provisions of this section is guilty of a

2-19  misdemeanor.

2-20    Sec. 3.  NRS 574.050 is hereby amended to read as follows:

2-21    574.050  As used in NRS 574.050 to 574.200, inclusive:

2-22    1.  “Animal” does not include the human race, but includes every other

2-23  living creature.

2-24    2.  “Police animal” means an animal which is owned or used by a state

2-25  or local governmental agency and which is used by a peace officer in

2-26  performing his duties as a peace officer.

2-27    3.  “Torture” or “cruelty” includes every act, omission or neglect,

2-28  whereby unjustifiable physical pain, suffering or death is caused or

2-29  permitted.

2-30    Sec. 4.  The amendatory provisions of this act do not apply to offenses

2-31  committed before the effective date of this act.

2-32    Sec. 5.  This act becomes effective upon passage and approval.
