AN ACT relating to public safety; making an appropriation to the Health Division of the Department of Human Resources for the purchase of automated external defibrillators for distribution to certain public places and establishments; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. There is hereby appropriated from the state general
1-2 fund to the Health Division of the Department of Human Resources for the
1-3 purchase and distribution of automated external defibrillators to public
1-4 places and establishments the sum of $100,000.
1-5 2. The Health Division shall use the money appropriated by subsection
1-6 1 to purchase at least 50 automated external defibrillators for distribution to
1-7 public places and establishments. In addition, the Health Division may
1-8 accept gifts and grants from any source to be used for the purchase of
1-9 additional automated external defibrillators.
1-10 3. An owner or operator of a public place or establishment may submit
1-11 an application to the Health Division on a form prescribed by the Health
1-12 Division for one or more automated external defibrillators for use on the
1-13 premises of the public place or establishment. The application must
1-14 include, without limitation, proof that at least one person employed by the
1-15 public place or establishment has successfully completed:
2-1 (a) A course in cardiopulmonary resuscitation; and
2-2 (b) Training in the operation and use of an automated external
2-3 defibrillator,
2-4 that were conducted in accordance with the standards of the American
2-5 Heart Association or the American National Red Cross.
2-6 4. The Health Division shall prioritize all the applications received
2-7 based upon its determination of the public places or establishments in
2-8 which the presence of automated external defibrillators will serve the
2-9 greatest public need. After the Health Division prioritizes the applications,
2-10 the Health Division shall distribute the automated external defibrillators
2-11 purchased pursuant to subsection 2 to those public places and
2-12 establishments:
2-13 (a) In order of priority; and
2-14 (b) Proportionately based upon the population in this state.
2-15 5. A public place or establishment that receives an automated external
2-16 defibrillator pursuant to this section shall:
2-17 (a) Comply with all current federal and state regulations governing the
2-18 use and placement of an automated external defibrillator;
2-19 (b) Ensure that the automated external defibrillator is maintained and
2-20 tested according to the operational guidelines established by the
2-21 manufacturer;
2-22 (c) Establish and maintain a program to ensure compliance with current
2-23 regulations, requirements for training, requirements for notification of
2-24 emergency medical assistance and guidelines for the maintenance of the
2-25 equipment; and
2-26 (d) Ensure that the automated external defibrillator is used to provide
2-27 care on the premises of the public place or establishment only by a person
2-28 who has successfully completed:
2-29 (1) A course in cardiopulmonary resuscitation; and
2-30 (2) Training in the operation and use of an automated external
2-31 defibrillator,
2-32 that were conducted in accordance with the standards of the American
2-33 Heart Association or the American National Red Cross.
2-34 6. The Health Division shall ensure that each public place or
2-35 establishment that receives an automated external defibrillator pursuant to
2-36 this section complies with the requirements of subsection 5.
2-37 7. On or before December 1, 2002, each public place or establishment
2-38 that receives an automated external defibrillator pursuant to this section
2-39 shall submit a written report to the Health Division. The written report
2-40 must include an evaluation of the overall success of the use of the
2-41 automated external defibrillator on the premises of the public place or
2-42 establishment, including, without limitation, the number of lives that were
2-43 saved, if any, by the use of the automated external defibrillator.
2-44 8. The Health Division shall:
2-45 (a) Compile the data contained in the reports submitted pursuant to
2-46 subsection 7; and
2-47 (b) On or before February 1, 2003, submit a written compilation of the
2-48 reports to the Director of the Legislative Counsel Bureau for transmission
2-49 to the 72nd session of the Nevada Legislature.
3-1 9. As used in this section, “public place or establishment” means a
3-2 place or establishment to which the public is invited or which is intended
3-3 for public use. The term includes, without limitation:
3-4 (a) Any public building which is owned or occupied by the State of
3-5 Nevada, any component of the University and Community College System
3-6 of Nevada, or any county, city, school district or other political subdivision
3-7 and which is used for any public purpose;
3-8 (b) Any motion picture house, theater, concert hall, sports arena or other
3-9 place of exhibition or entertainment;
3-10 (c) Any auditorium, convention center, lecture hall, stadium or other
3-11 place of public gathering;
3-12 (d) Any grocery store, shopping center or other sales or retail
3-13 establishment;
3-14 (e) Any terminal, depot or other station used for specified public
3-15 transportation; and
3-16 (f) Any park, zoo, amusement park or other place of recreation.
3-17 10. Any remaining balance of the appropriation made by subsection 1
3-18 must not be committed for expenditure after June 30, 2003, and reverts to
3-19 the state general fund as soon as all payments of money committed have
3-20 been made.
3-21 Sec. 2. This act becomes effective upon passage and approval.
