AN ACT relating to motor vehicles; requiring the director of the department of motor vehicles and public safety to establish a toll-free telephone number for the reporting of certain violations relating to the registration of a vehicle; requiring the department to notify the appropriate local law enforcement agency of violations; making an appropriation; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 482 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 The director shall:
1-4 1. Establish and maintain a toll-free telephone number for persons
1-5 to report to the department information concerning alleged violations of
1-6 subsection 3 of NRS 482.385.
1-7 2. Establish procedures pursuant to which employees of the
1-8 department will receive information reported pursuant to subsection 1
1-9 and, based upon the information so received, determine the appropriate
1-10 action to be taken in response to the information.
1-11 Sec. 2. NRS 482.385 is hereby amended to read as follows:
1-12 482.385 1. Except as otherwise provided in subsection 4 and NRS
1-13 482.390, a nonresident owner of a vehicle of a type subject to registration
1-14 pursuant to the provisions of this chapter, owning any vehicle which has
1-15 been registered for the current year in the state, country or other place of
1-16 which the owner is a resident and which at all times when operated in this
1-17 state has displayed upon it the registration license plate issued for the
2-1 vehicle in the place of residence of the owner, may operate or permit the
2-2 operation of the vehicle within this state without its registration in this state
2-3 pursuant to the provisions of this chapter and without the payment of any
2-4 registration fees to this state.
2-5 2. This section does not:
2-6 (a) Prohibit the use of manufacturers’, distributors’ or dealers’ license
2-7 plates issued by any state or country by any nonresident in the operation of
2-8 any vehicle on the public highways of this state.
2-9 (b) Require registration of vehicles of a type subject to registration
2-10 pursuant to the provisions of this chapter operated by nonresident common
2-11 motor carriers of persons or property, contract motor carriers of persons or
2-12 property, or private motor carriers of property as stated in NRS 482.390.
2-13 (c) Require registration of a vehicle operated by a border state
2-14 employee.
2-15 3. When a person, formerly a nonresident, becomes a resident of this
2-16 state, he shall:
2-17 (a) Within 30 days after becoming a resident; or
2-18 (b) At the time he obtains his driver’s license,
2-19 whichever occurs earlier, apply for the registration of any vehicle which he
2-20 owns and which is operated in this state. If a person fails to register a
2-21 vehicle within 10 days after the last day allowed for timely registration
2-22 pursuant to this subsection, the department shall notify the appropriate
2-23 local law enforcement agency that the person is in violation of this
2-24 subsection.
2-25 4. Any resident operating a motor vehicle upon a highway of this state
2-26 which is owned by a nonresident and which is furnished to the resident
2-27 operator for his continuous use within this state, shall cause that vehicle to
2-28 be registered within 30 days after beginning its operation within this state.
2-29 5. A person registering a vehicle pursuant to the provisions of
2-30 subsection 3, 4 or 6 [of this section] or pursuant to NRS 482.390 must be
2-31 assessed the registration fees and governmental services tax, as required by
2-32 the provisions of this chapter and chapter 371 of NRS. He must not be
2-33 allowed credit on those taxes and fees for the unused months of his
2-34 previous registration.
2-35 6. If a vehicle is used in this state for a gainful purpose, the owner
2-36 shall immediately apply to the department for registration, except as
2-37 otherwise provided in NRS 482.390, 482.395 and 706.801 to 706.861,
2-38 inclusive.
2-39 7. An owner registering a vehicle pursuant to the provisions of this
2-40 section shall surrender the existing nonresident license plates and
2-41 registration certificates to the department for cancellation.
2-42 8. A vehicle may be cited for a violation of this section regardless of
2-43 whether it is in operation or is parked on a highway, in a public parking lot
2-44 or on private property which is open to the public if, after communicating
2-45 with the owner or operator of the vehicle, the peace officer issuing the
2-46 citation determines that:
2-47 (a) The owner of the vehicle is a resident of this state; or
2-48 (b) The vehicle is used in this state for a gainful purpose.
3-1 Sec. 3. 1. There is hereby appropriated from the state highway fund
3-2 to the department of motor vehicles and public safety the sum of $109,000
3-3 for the purchase of equipment to establish and maintain the toll-free
3-4 telephone number pursuant to section 1 of this act and for the costs related
3-5 to a multimedia advertising campaign to inform the public about the toll-
3-6 free telephone number and its purpose.
3-7 2. Any remaining balance of the appropriation made by subsection 1
3-8 must not be committed for expenditure after June 30, 2003, and reverts to
3-9 the state highway fund as soon as all payments of money committed have
3-10 been made.
3-11 Sec. 4. 1. This section and sections 1 and 3 of this act become
3-12 effective on July 1, 2001.
3-13 2. Section 2 of this act becomes effective at 12:01 a.m. on
3-14 July 1, 2001.
