AN ACT relating to contractors; requiring the suspension of a contractor’s license by the state contractors’ board if the licensee has failed to comply with a certain number of administrative citations; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 624 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 1. Except as otherwise provided in subsection 3, if the board issues a
1-4 written administrative citation pursuant to NRS 624.341 that includes an
1-5 order to correct a condition resulting from an act which constitutes a
1-6 cause for disciplinary action to a licensee who performs residential
1-7 construction and who the board believes has at least nine other
1-8 outstanding citations, the board shall:
1-9 (a) Conduct a hearing pursuant to NRS 624.291 to determine whether
1-10 the licensee has at least 10 outstanding citations; or
1-11 (b) Suspend the license of the licensee, in accordance with subsection
1-12 4 of NRS 624.291, for all purposes related to residential construction
1-13 except for the purpose of correcting the outstanding violations.
1-14 2. If the board issues, during a hearing, a written administrative
1-15 citation pursuant to NRS 624.341 that includes an order to correct a
1-16 condition resulting from an act which constitutes a cause for disciplinary
1-17 action to a licensee who performs residential construction, the board
1-18 shall determine at that hearing whether the licensee has at least 10
1-19 outstanding citations, including the citation issued at the hearing.
1-20 3. If the board determines at a hearing that the licensee has at least
1-21 10 outstanding citations pursuant to subsection 1 or 2, the board shall
1-22 suspend the license issued to the licensee for all purposes related to
2-1 residential construction except for the purpose of correcting the
2-2 outstanding violations.
2-3 4. If the board suspends a license pursuant to this section, the board
2-4 shall not reinstate the license until:
2-5 (a) At least 30 days after the date the license is suspended; and
2-6 (b) The board determines that the total number of outstanding
2-7 citations issued to the licensee is five or less.
2-8 5. Except as otherwise provided in this subsection, as used in this
2-9 section, “outstanding citation” means a written administrative citation
2-10 issued to a licensee pursuant to NRS 624.341 which includes an order to
2-11 take action to correct a condition resulting from an act that constitutes a
2-12 cause for disciplinary action and with which the licensee has not
2-13 complied to the satisfaction of the board. If a civil action is initiated
2-14 concerning an act for which a written administrative citation has been
2-15 issued by the board, the citation is not an outstanding citation.
