AN ACT relating to public schools; revising provisions governing the use of certain proceeds of bonds for a pilot program of a certain school district for the replacement of schools; requiring a certain school district to continue its pilot program for the replacement of schools; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Section 3 of chapter 562, Statutes of Nevada 1999, at page

1-2  2947, is hereby amended to read as follows:

1-3  Sec. 3.  1.  The legislature hereby finds and declares that:

1-4  (a) The deterioration of school facilities has become a grave

1-5  concern in this state;

1-6  (b) The local governments in the various portions of the state are

1-7  currently faced with unique financial problems resulting from a

1-8  variety of situations because in some local governments the

1-9  population is rapidly increasing whereas in others the population is

1-10  generally declining;

1-11  (c) Some local governments are still attempting to rehabilitate

1-12  schools that were built around the turn of the last century and others

1-13  cannot build new schools quickly enough to meet the needs of the

1-14  children in the district; and

1-15  (d) Because of the unique variety of problems facing the local

1-16  governments of this state a general law cannot be made applicable to

1-17  ensure that children in more densely populated urban areas are

1-18  provided with a safe environment which encourages learning.

1-19  2.  The board of trustees of the Clark County School District shall

1-20  establish a pilot program to replace schools. The school district may


2-1  use an amount not to exceed [$15] $18 million from the proceeds of

2-2  the bonds issued pursuant to subsection 3 or 4 of NRS 350.020 to:

2-3  (a) Evaluate older schools within the district to determine the need

2-4  for renovation or reconstruction of those schools in furtherance of

2-5  section 2 of this act; and

2-6  (b) Reconstruct one existing elementary school designated by the

2-7  board of trustees from among the three schools analyzed in 1998 by

2-8  the board of trustees in the study entitled “Rehab vs. Replacement

2-9  Study/Phase Analysis.” The board of trustees, upon designating the

2-10  school to be reconstructed, shall with all deliberate speed commence

2-11  the reconstruction of the designated school with a planned completion

2-12  date [of July 1, 2001.] as soon as is practicable.

2-13  3.  The purpose of this section is to provide authority to expend

2-14  the proceeds of the bonds issued pursuant to subsection 3 or 4 of NRS

2-15  350.020 for reconstruction that is additional to and does not replace,

2-16  repeal or limit any existing authority to so expend such proceeds.

2-17  4.  On or before February 1, 2001, the Clark County School

2-18  District shall submit to the director of the legislative counsel bureau

2-19  for transmission to the 71st session of the Nevada legislature an

2-20  interim report regarding the pilot program to replace schools. The

2-21  report must include, without limitation, the progress of the effort to

2-22  evaluate the older schools conducted pursuant to paragraph (a) of

2-23  subsection 2 of this section and the progress of the reconstruction of

2-24  the designated elementary school.

2-25    Sec. 2.  1.  The board of trustees of the Clark County School District

2-26  shall continue the pilot program established pursuant to section 3 of

2-27  chapter 562, Statutes of Nevada 1999, at page 2947.

2-28    2.  The board of trustees of the Clark County School District may use

2-29  an amount not to exceed $90 million from the proceeds of the bonds issued

2-30  pursuant to subsection 3 or 4 of NRS 350.020 to reconstruct five existing

2-31  schools within the school district. The board of trustees shall select the

2-32  schools designated for reconstruction in accordance with the policy

2-33  adopted pursuant to NRS 393.100 concerning the renovation or

2-34  reconstruction of older buildings for schools or related facilities and any

2-35  priorities for reconstruction set forth in that policy. The board of trustees,

2-36  upon designating the five schools to be reconstructed, shall with all

2-37  deliberate speed commence the reconstruction of the designated schools

2-38  with a planned completion date of July 1, 2005.

2-39    3.  The purpose of this section is to provide authority to expend the

2-40  proceeds of bonds issued pursuant to subsection 3 or 4 of NRS 350.020 for

2-41  reconstruction that is additional to and does not replace, repeal or limit any

2-42  existing authority to so expend such proceeds.

2-43    4.  On or before February 1, 2003, the board of trustees of the Clark

2-44  County School District shall submit to the director of the legislative

2-45  counsel bureau for transmission to the 72nd session of the Nevada

2-46  legislature an interim report regarding the pilot program to replace schools.

2-47  The report must include, without limitation, the progress of the

2-48  reconstruction of the five designated schools.

 


3-1    Sec. 3.  This act becomes effective on July 1, 2001.
