AN ACT relating to regional transportation commissions; increasing the membership of the regional transportation commission in certain less populous counties; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 373.040 is hereby amended to read as follows:
1-2 373.040 1. In counties whose population is 100,000 or more, the
1-3 commission must be composed of representatives selected by the following
1-4 entities from among their members:
1-5 (a) Two by the board.
1-6 (b) Two by the governing body of the largest city.
1-7 (c) One by the governing body of each additional city in the county.
1-8 2. In counties whose population is less than 100,000, the commission
1-9 must be composed of representatives selected as follows:
1-10 (a) If the county contains [a] three or more cities:
1-11 (1) Two by the board.
1-12 (2) One by the governing body of the largest city.
1-13 (b) If the county contains only two cities:
1-14 (1) Three by the board, at least one of whom is a representative of
1-15 the public who is a resident of the county.
1-16 (2) One by the governing body of each city in the county.
1-17 (c) If the county contains only one city:
1-18 (1) Two by the board.
1-19 (2) One by the governing body of the [largest city.
1-20 (b)] city.
2-1 (d) If the county contains no city, the board shall select:
2-2 (1) Two members of the board; and
2-3 (2) One representative of the public, who is a resident of the largest
2-4 town, if any, in the county.
2-5 3. In Carson City, the commission must be composed of
2-6 representatives selected by the board of supervisors as follows:
2-7 (a) Two members of the board of supervisors, one of whom must be
2-8 designated by the commission to serve as chairman of the commission.
2-9 (b) Three representatives of the city at large.
2-10 4. The first representatives must be selected within 30 days after
2-11 passage of the ordinance creating the commission, and, except as otherwise
2-12 provided in subsections 5, 6 and 7, must serve until the next ensuing
2-13 December 31 of an even-numbered year. The representative of any city
2-14 incorporated after passage of the ordinance must be selected within 30 days
2-15 after the first meeting of the governing body, and, except as otherwise
2-16 provided in subsection 7, must serve until the next ensuing December 31 of
2-17 an even-numbered year. Their successors must serve for terms of 2 years,
2-18 and vacancies must be filled for the unexpired term.
2-19 5. In Carson City:
2-20 (a) One representative of the commission who is a member of the board
2-21 of supervisors and one representative of the commission who is a
2-22 representative of the city at large must serve until the next ensuing
2-23 December 31 of an even-numbered year; and
2-24 (b) One representative of the commission who is a member of the board
2-25 of supervisors and two representatives of the commission who are
2-26 representatives of the city at large must serve until the next ensuing
2-27 December 31 of an odd-numbered year.
2-28 6. In counties whose population is 100,000 or more, but less than
2-29 400,000:
2-30 (a) One representative selected by the board and one representative
2-31 selected by the governing body of the largest city in the county must serve
2-32 until the next ensuing December 31 of an even-numbered year; and
2-33 (b) One representative selected by the board and one representative
2-34 selected by the governing body of the largest city in the county must serve
2-35 until the next ensuing December 31 of an odd-numbered year.
2-36 7. In counties whose population is 400,000 or more, the first
2-37 representatives and the representative of any city incorporated after
2-38 passage of the ordinance must serve until the next ensuing June 30 of an
2-39 odd-numbered year.
2-40 Sec. 2. The additional representatives required by the amendatory
2-41 provisions of section 1 of this act to be selected to serve as members of the
2-42 regional transportation commission of a county whose population is less
2-43 than 100,000 that contains only two cities must be selected as soon as
2-44 practicable after July 1, 2001, and must serve until December 31, 2002.
2-45 Sec. 3. This act becomes effective on July 1, 2001.
