AN ACT relating to metropolitan police departments; authorizing a sheriff to adopt certain policies, procedures, rules and regulations for the administration of a metropolitan police department; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 280 of NRS is hereby amended by adding thereto a
1-2 new section to read as follows:
1-3 The sheriff of the county in which a department is located may adopt
1-4 such policies, procedures, rules and regulations for the administration of
1-5 the department and the employees of the department as he deems
1-6 appropriate without obtaining the approval of the board or the
1-7 committee. Such policies, procedures, rules and regulations must not
1-8 conflict with the regulations prepared by the board and adopted by the
1-9 committee pursuant to subsection 4 of NRS 280.310.
1-10 Sec. 2. NRS 280.310 is hereby amended to read as follows:
1-11 280.310 1. Each department shall have a system of civil service,
1-12 applicable to and governing all employees of the department except elected
1-13 officers and such other positions as designated by the committee.
1-14 2. The system of civil service must be governed by a board composed
1-15 of five civil service trustees appointed by the committee. Upon creation of
1-16 the board, the committee shall appoint one trustee for a term of 2 years,
1-17 two trustees for terms of 3 years and two trustees for terms of 4 years.
1-18 Thereafter the terms of all trustees are 4 years.
2-1 3. The members of the board may administer any oath or affirmation
2-2 necessary in discharging its duties. The board may issue subpoenas in the
2-3 discharge of its duties in the same manner as a subpoena is issued in a civil
2-4 action.
2-5 4. The board shall prepare regulations governing the system of civil
2-6 service to be adopted by the committee. The regulations must provide for:
2-7 (a) Examination of potential employees;
2-8 (b) Recruitment and placement procedures;
2-9 (c) Classification of positions; and
2-10 (d) Procedures for promotion, disciplinary actions and removal of
2-11 employees . [; and
2-12 (e) Such other matters as the board may consider necessary.]
2-13 5. Copies of the regulations of the system of civil service must be
2-14 distributed to all employees of the department.
2-15 6. The sheriff shall designate a personnel officer to administer the
2-16 personnel functions of the department according to the policies and
2-17 regulations of the board . [, including, but not limited to, the items
2-18 enumerated in subsection 4.]
2-19 7. In any hearing or other proceeding conducted by the board, an
2-20 employee of the department, may represent himself or be represented by
2-21 any person of the employee’s own choosing.
2-22 Sec. 3. This act becomes effective on July 1, 2001.
