AN ACT relating to the charter of Carson City; establishing a residency requirement for members of advisory boards; prohibiting certain officers from serving on certain boards after their terms of office expire; revising the requirements for the office of purchasing and contracts; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

1-1  SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-2    Section 1.  The charter of Carson City, being chapter 213, Statutes of

1-3  Nevada 1969, at page 287, is hereby amended by adding thereto a new

1-4  section to be designated as section 3.140, immediately following section

1-5  3.130, to read as follows:

1-6    Sec. 3.140  Officers: Removal from public board. The following

1-7  officers may not continue to serve as representatives on a public

1-8  board, if they obtained such position by virtue of their elected office,

1-9  after their term in office has expired:

1-10    1.  The mayor;

1-11    2.  A supervisor;

1-12    3.  The clerk;

1-13    4.  The treasurer;

1-14    5.  The assessor;

1-15    6.  The sheriff; and

1-16    7.  The district attorney.

 

 


2-1    Sec. 2.  Section 2.320 of the charter of Carson City, being chapter 690,

2-2  Statutes of Nevada 1979, at page 1857, is hereby amended to read as

2-3  follows:

2-4  Sec. 2.320  Power of board: Advisory boards. The board may by

2-5  resolution or ordinance create advisory boards comprised of elected

2-6  and appointed officers and representatives of the people of Carson

2-7  City to advise the board of supervisors in specific areas of local

2-8  government, including, without limitation , public safety, public

2-9  employees, finance, human resources and public property and

2-10  facilities. A person serving on an advisory board that only serves

2-11  Carson City must be a resident of Carson City and registered to vote

2-12  in Carson City.

2-13    Sec. 3.  Section 3.077 of the charter of Carson City, being chapter 690,

2-14  Statutes of Nevada 1979, as amended by chapter 535, Statutes of Nevada

2-15  1993, at page 2240, is hereby amended to read as follows:

2-16  Sec. 3.077  Office of purchasing and contracts; director.

2-17  1.  [There is created] The board may create in Carson City an

2-18  office of purchasing and contracts to be administered by a director of

2-19  purchasing and contracts appointed by the manager. If there is no

2-20  manager , the board [shall] may appoint the director of purchasing and

2-21  contracts. The salary of the director must be fixed by the board.

2-22  2.  [The] If an office of purchasing and contracts is created, the

2-23  director of purchasing and contracts shall:

2-24  (a) Administer the purchasing and contracts programs of Carson

2-25  City, including the preparation, award and acceptance of formal

2-26  contracts, agreements and construction bids and the purchase of

2-27  materials, equipment, supplies and professional services for all offices

2-28  and departments of Carson City.

2-29  (b) Comply with the provisions of the Local Government

2-30  Purchasing Act.

2-31  (c) Within the limits of available money, maintain an inventory of

2-32  supplies that are used on a repeated basis.

2-33  (d) With the assistance of the controller, establish procedures for

2-34  emergency purchases of materials, equipment and supplies by

2-35  individual offices and departments.

2-36  (e) Perform other duties as directed by the manager.

2-37    Sec. 4.  This act becomes effective on July 1, 2001.
