AN ACT relating to counties; authorizing a board of county commissioners to provide by ordinance for the covering or removal of certain graffiti on private property at county expense; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 244.3693 is hereby amended to read as follows:
1-2 244.3693 1. The board of county commissioners shall remove or
1-3 cover all evidence that graffiti has been placed on any real or personal
1-4 property which it owns or otherwise controls within 15 days after it
1-5 discovers the graffiti or as soon as practicable.
1-6 2. The board of county commissioners may bring an action against a
1-7 person responsible for placing graffiti on the property of the county to
1-8 recover a civil penalty and damages for the cost of removing or covering
1-9 the graffiti placed on such property.
1-10 3. The board of county commissioners may adopt by ordinance
1-11 procedures pursuant to which officers, employees or other designees of
1-12 the county may enter private property to cover or remove graffiti that is
1-13 placed on the exterior of any building, fence or other structure located on
1-14 that private property if the graffiti is visible from a public right of way.
1-15 An ordinance adopted pursuant to this subsection must provide that:
1-16 (a) Officers, employees or other designees of the county shall not
1-17 enter private property to cover or remove graffiti unless:
1-18 (1) The owner of the private property consents to such entry to
1-19 cover or remove the graffiti; or
2-1 (2) If the board of county commissioners or its designee is unable to
2-2 contact the owner of the private property to obtain his consent, the board
2-3 first provides the owner of the private property with written notice sent by
2-4 certified mail, return receipt requested, at least 72 hours before the
2-5 officers, employees or other designees of the county enter his property to
2-6 cover or remove the graffiti.
2-7 (b) The county shall pay the cost of covering or removing such graffiti
2-8 on private property.
2-9 Sec. 2. This act becomes effective upon passage and approval.
