AN ACT relating to property; establishing a statute of limitation for certain actions for inverse condemnation; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 37 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    Except as otherwise provided in NRS 408.497, an action by an owner

1-4  of real property to recover property that has been taken by a person

1-5  exercising the right of eminent domain where no complaint has been

1-6  filed in a proceeding in eminent domain for the acquisition of the

1-7  property or any interest therein must be commenced within 8 years after

1-8  the date of the taking.

1-9    Sec. 2.  The amendatory provisions of this act apply to an action by an

1-10  owner of real property concerning property that is taken on or after
October 1, 2001.
