AN ACT relating to state financial administration; removing the limitation on the amount of the proceeds from fees and other charges related to the operation of motor vehicles that may be used to pay the costs of administration; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 408.235 is hereby amended to read as follows:
1-2 408.235 1. There is hereby created the state highway fund.
1-3 2. Except as otherwise provided in subsection 7 of NRS 482.180 and
1-4 NRS 482.1805, the proceeds from the imposition of any:
1-5 (a) License or registration fee and other charges with respect to the
1-6 operation of any motor vehicle upon any public highway, city, town or
1-7 county road, street, alley or highway in this state; and
1-8 (b) Excise
tax on gasoline or other motor vehicle
fuel,
1-9 must be deposited in the state highway fund and must, except for costs of
1-10 administering the collection thereof, be used exclusively for administration,
1-11 construction, reconstruction, improvement and maintenance of highways as
1-12 provided for in this chapter.
1-13 3. The interest and income earned on the money in the state highway
1-14 fund, after deducting any applicable charges, must be credited to the fund.
1-15 4. [Costs of administration for the collection of the proceeds for any
1-16 license or registration fees and other charges with respect to the operation
1-17 of any motor vehicle must be limited to a sum not to exceed 22 percent of
1-18 the total proceeds so collected.
2-1 5.] Costs of administration for the collection of any excise tax on
2-2 gasoline or other motor vehicle fuel must be limited to a sum not to exceed
2-3 1 percent of the total proceeds so collected.
2-4 [6.] 5. All bills and charges against the state highway fund for
2-5 administration, construction, reconstruction, improvement and maintenance
2-6 of highways under the provisions of this chapter must be certified by the
2-7 director and must be presented to and examined by the state board of
2-8 examiners. When allowed by the state board of examiners and upon being
2-9 audited by the state controller, the state controller shall draw his warrant
2-10 therefor upon the state treasurer.
2-11 Sec. 2. This act becomes effective on July 1, 2001.
