AN ACT relating to rural health; creating in the state general fund the revolving loan account to provide assistance to certain rural health programs to make loans to rural health programs that require such assistance; establishing the Nevada office of rural health within the University of Nevada School of Medicine; making appropriations; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 353 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  The revolving loan account to provide assistance to certain rural

1-4  health programs is hereby created in the state general fund.

1-5    2.  The money in the account must be used solely to make loans to

1-6  rural health programs that require such assistance.

1-7    3.  The account must be administered by the director of the

1-8  department of human resources, who may apply for and accept any gift,

1-9  donation, bequest, grant or other source of money for deposit in the

1-10  account.

1-11    4.  The interest and income earned on the money in the account, after

1-12  deducting any applicable charges, must be credited to the account.

1-13    5.  The money in the account must remain in the account and does

1-14  not revert to the state general fund at the end of any fiscal year.

1-15    6.  The director of the department shall adopt regulations to carry out

1-16  the provisions of this section. The regulations must include, without

1-17  limitation:

1-18    (a) The procedure by which a person may apply for a loan of money

1-19  from the account to provide assistance to certain rural health programs;


2-1    (b) The criteria that the department will consider in determining

2-2  whether to award such a loan of money from the account; and

2-3    (c) Procedures to distribute the money in the account in a fair and

2-4  equitable manner.

2-5    Sec. 2.  NRS 232.355 is hereby amended to read as follows:

2-6    232.355  1.  Except for gifts or grants specifically accounted for in

2-7  another fund[,] or account, all gifts or grants of money or other property

2-8  which the divisions of the department of human resources are authorized to

2-9  accept must be accounted for in the department of human resources’ gift

2-10  fund, hereby created as a trust fund. The fund is a continuing fund without

2-11  reversion. The department may establish such accounts in the fund as are

2-12  necessary to account properly for gifts received. All money received by the

2-13  division must be deposited in the state treasury for credit to the fund. The

2-14  money in the fund must be paid out on claims as other claims against the

2-15  state are paid. Unless otherwise specifically provided by statute, claims

2-16  against the fund must be approved by the director or his delegate.

2-17    2.  Gifts of property other than money may be sold or exchanged when

2-18  this is deemed by the head of the facility or agency responsible for the gift

2-19  to be in the best interest of the facility or agency. The sale price must not

2-20  be less than 90 percent of the value determined by a qualified appraiser

2-21  appointed by the head of the facility or agency. All money received from

2-22  the sale must be deposited in the state treasury to the credit of the

2-23  appropriate gift account in the department of human resources’ gift fund.

2-24  The money may be spent only for the purposes of the facility or agency

2-25  named in the title of the account. The property may not be sold or

2-26  exchanged if to do so would violate the terms of the gift.

2-27    Sec. 3.  Chapter 396 of NRS is hereby amended by adding thereto a

2-28  new section to read as follows:

2-29    1.  The Nevada office of rural health is hereby established within the

2-30  University of Nevada School of Medicine.

2-31    2.  The Nevada office of rural health shall address the need for and

2-32  recommend programs concerning the delivery of health care services to

2-33  rural and frontier populations. The office shall administer or coordinate,

2-34  or both, programs and services which affect the delivery of health care

2-35  services in rural areas including, without limitation, programs and

2-36  services in the following categories:

2-37    (a) Education and training;

2-38    (b) Needs of special populations;

2-39    (c) Delivery of health services; and

2-40    (d) Financing of health care.

2-41    Sec. 4.  There is hereby appropriated from the state general fund to the

2-42  revolving loan account to provide assistance to certain rural health

2-43  programs the sum of $500,000.

2-44    Sec. 5.  1.  There is hereby appropriated from the state general fund

2-45  to the Nevada Rural Health Centers, Inc., for its Carlin, Nevada, clinic the

2-46  sum of $70,000.

2-47    2.  Any remaining balance of the appropriation made by subsection 1

2-48  must not be committed for expenditure after June 30, 2003, and reverts to


3-1  the state general fund as soon as all payments of money committed have

3-2  been made.

3-3    Sec. 6.  This act becomes effective upon passage and approval.
