AN ACT relating to economic development; creating the Advisory Commission on Internet Commerce; prescribing the membership and duties of the Advisory Commission; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. 1.  The Advisory Commission on Internet Commerce is

1-2  hereby created. The Advisory Commission consists of the Executive

1-3  Director of the Commission on Economic Development, who serves ex

1-4  officio, and 11 members appointed pursuant to this section.

1-5    2.  The Majority Leader of the Senate shall appoint three members to

1-6  the Advisory Commission as follows:

1-7    (a) One Senator; and

1-8    (b) Two persons, each of whom are employed in an executive-level

1-9  position by a technology or software company located in Washoe County

1-10  that employs at least 50 persons.

1-11    3.  The Minority Leader of the Senate shall appoint one member to the

1-12  Advisory Commission who is a Senator.

1-13    4.  The Speaker of the Assembly shall appoint three members to the

1-14  Advisory Commission as follows:

1-15    (a) One Assemblyman; and

1-16    (b) Two persons, each of whom are employed in an executive-level

1-17  position by a technology or software company located in Clark County that

1-18  employs at least 50 persons.

1-19    5.  The Minority Leader of the Assembly shall appoint one member to

1-20  the Advisory Commission who is an Assemblyman.

1-21    6.  The Governor shall appoint, from a list of nominations provided by

1-22  the Lieutenant Governor, three members to the Advisory Commission as

1-23  follows:


2-1    (a) One person who is employed in an executive-level position by a

2-2  company that has relocated to Southern Nevada within the immediately

2-3  preceding year;

2-4    (b) One person who is employed in an executive-level position by a

2-5  company that has relocated to Northern Nevada within the immediately

2-6  preceding year; and

2-7    (c) One person who is employed in an executive-level position by a

2-8  venture capital investment company that is headquartered in this state and

2-9  has operated in this state for at least 2 years.

2-10    7.  A vacancy in the membership of the Advisory Commission must be

2-11  filled in the same manner as the original appointment for the remainder of

2-12  the unexpired term.

2-13    8.  The Director of the Legislative Counsel Bureau shall provide such

2-14  personnel, facilities, equipment and supplies as the Advisory Commission

2-15  may require to carry out its duties.

2-16    9.  Upon the request of the Advisory Commission, an officer, agency or

2-17  department of this state shall provide to the Advisory Commission such

2-18  information and assistance as the Commission considers necessary to carry

2-19  out its duties.

2-20    Sec. 2.  1.  The Advisory Commission shall hold six public meetings

2-21  throughout this state. At its first meeting, the Advisory Commission shall

2-22  elect a chairman and vice chairman from among its members.

2-23    2.  The chairman of the Advisory Commission may create

2-24  subcommittees comprised of members of the Advisory Commission,

2-25  appoint a chairman of each such subcommittee and assign various topics of

2-26  study to the subcommittees. Each such subcommittee may conduct

2-27  meetings and report its findings and recommendations to the Advisory

2-28  Commission.

2-29    3.  For each day or portion of a day during which a member of the

2-30  Advisory Commission who is a Legislator attends a meeting of the

2-31  Advisory Commission or its subcommittee, or is otherwise engaged in the

2-32  business of the Commission, except during a regular or special session of

2-33  the Legislature, he is entitled to receive, payable from the Legislative

2-34  Fund:

2-35    (a) Compensation provided for a majority of the members of the

2-36  Legislature during the first 60 days of the preceding session;

2-37    (b) Per diem allowance provided for state officers and employees

2-38  generally; and

2-39    (c) Travel expenses provided pursuant to NRS 218.2207.

2-40    4.  For each day or portion of a day during which the Executive

2-41  Director of the Commission on Economic Development attends a meeting

2-42  of the Advisory Commission or its subcommittee, or is otherwise engaged

2-43  in the business of the Advisory Commission, he is entitled to receive his

2-44  regular salary and the per diem allowance and travel expenses provided for

2-45  state officers and employees generally, payable from the budget of the

2-46  Commission on Economic Development.

2-47    5.  Except as otherwise provided in subsections 3 and 4, the members

2-48  of the Advisory Commission serve without salary or other compensation

2-49  and are not entitled to receive per diem allowances or travel expenses.


3-1    Sec. 3.  1.  The Advisory Commission shall examine policies and

3-2  make recommendations to ensure that Internet commerce continues to

3-3  grow and prosper in this state, while providing social and economic

3-4  benefits to the residents, governmental entities and businesses of this state.

3-5  The scope of the study conducted by the Advisory Commission must

3-6  include, without limitation:

3-7    (a) Methods to facilitate electronic commerce in this state, including,

3-8  without limitation, an assessment of this state’s current technological

3-9  infrastructure and recommendations to enhance the infrastructure;

3-10    (b) Methods to encourage the provision of governmental services

3-11  through the Internet, to the extent practicable and feasible;

3-12    (c) Policies regarding the taxation of Internet commerce;

3-13    (d) Methods to ensure the privacy and protection of customers who

3-14  engage in Internet commerce;

3-15    (e) Electronic security and encryption technology; and

3-16    (f) Policies regarding the regulation of unsolicited electronic mail.

3-17    2.  On or before August 31, 2002, the Advisory Commission may

3-18  request the preparation of not more than two legislative measures to carry

3-19  out the recommendations of the Commission.

3-20    3.  The Advisory Commission shall, not later than November 1, 2002,

3-21  prepare and submit a report of its findings from the study conducted

3-22  pursuant to subsection 1 and any recommendations for legislation to the:

3-23    (a) Governor; and

3-24    (b) Director of the Legislative Counsel Bureau for transmittal to the

3-25  72nd session of the Legislature.

3-26    Sec. 4.  On or before July 1, 2001, the Majority Leader of the Senate,

3-27  the Minority Leader of the Senate, the Speaker of the Assembly, the

3-28  Minority Leader of the Assembly and the Governor shall make

3-29  appointments of members to the Advisory Commission on Internet

3-30  Commerce pursuant to section 1 of this act. The terms of those members

3-31  expire on December 31, 2002.

3-32    Sec. 5.  1.  This section and section 4 of this act become effective

3-33  upon passage and approval.

3-34    2.  Section 1 of this act becomes effective upon passage and approval

3-35  for the purpose of appointing members to the Advisory Commission on

3-36  Internet Commerce and on July 1, 2001, for all other purposes.

3-37    3.  Sections 2 and 3 of this act become effective on July 1, 2001.

3-38    4.  This act expires by limitation on December 31, 2002.

 

3-39  H
