AN ACT relating to petroleum products; authorizing the state board of agriculture to adopt standards for liquefied petroleum gas that is used as a motor fuel; prohibiting the board for the regulation of liquefied petroleum gas from adopting regulations relating to the establishment of standards for fuel; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 590.020 is hereby amended to read as follows:
1-2 590.020 As used in NRS 590.010 to 590.330, inclusive, unless the
1-3 context otherwise requires:
1-4 1. “Additives” means a substance to be added to a motor oil or
1-5 lubricating oil to impart or improve desirable properties or to suppress
1-6 undesirable properties.
1-7 2. “Advertising medium” means any sign, printed or written matter, or
1-8 device for oral or visual communication.
1-9 3. “Performance rating” means the system adopted by the American
1-10 Petroleum Institute for the classification of uses for which an oil is
1-11 designed.
1-12 4. “Petroleum products” means gasoline, diesel fuel, burner fuel
1-13 kerosene, motor vehicle fuel, lubricating oil, motor oil or any product
1-14 represented as motor oil or lubricating oil. The term does not include
1-15 [liquefied] :
1-16 (a) Liquefied petroleum gas , unless it is used as a motor fuel; or
1-17 [motor]
2-1 (b) Motor oil additives.
2-2 5. “Recycled oil” means a petroleum product which is prepared from
2-3 used motor oil or used lubricating oil. The term includes rerefined oil.
2-4 6. “Rerefined oil” means used oil which is refined after its previous
2-5 use to remove from the oil any contaminants acquired during the previous
2-6 use.
2-7 7. “Used oil” means any oil which has been refined from crude or
2-8 synthetic oil and, as a result of use, has become unsuitable for its original
2-9 purpose because of a loss of its original properties or the presence of
2-10 impurities, but which may be suitable for another use or economically
2-11 recycled.
2-12 8. “Viscosity grade classification” means the measure of an oil’s
2-13 resistance to flow at a given temperature according to the grade
2-14 classification system of the Society of Automotive Engineers or other
2-15 grade classification.
2-16 Sec. 2. NRS 590.505 is hereby amended to read as follows:
2-17 590.505 1. The board may adopt a seal for its [own] use which must
2-18 have imprinted thereon the words “Board for the Regulation of Liquefied
2-19 Petroleum Gas.” The care and custody of the seal is the responsibility of
2-20 the secretary-treasurer of the board.
2-21 2. The board may appoint an executive secretary and may employ or,
2-22 pursuant to NRS 284.173, contract with such other technical, clerical or
2-23 investigative personnel as it deems necessary. The board shall fix the
2-24 compensation of the executive secretary and all other employees and
2-25 independent contractors. Such compensation must be paid out of the
2-26 money of the board. The board may require the executive secretary and any
2-27 other employees and independent contractors to give a bond to the board
2-28 for the faithful performance of their duties, the premiums on the bond
2-29 being paid out of the money of the board.
2-30 3. In carrying out the provisions of NRS 590.465 to 590.645, inclusive,
2-31 and holding its regular or special meetings, the board:
2-32 (a) Shall adopt written policies setting forth procedures and methods of
2-33 operation for the board.
2-34 (b) May adopt such regulations as it deems necessary. The board shall
2-35 not adopt regulations relating to the standards for fuel that the state
2-36 board of agriculture is required to adopt pursuant to NRS 590.070.
2-37 4. The board shall submit to the legislature and the governor a biennial
2-38 report before September 1 of each even-numbered year, covering the
2-39 biennium ending June 30 of that year, of its transactions during the
2-40 preceding biennium, including a complete statement of the receipts and
2-41 expenditures of the board during the period and any complaints received by
2-42 the board.
2-43 5. The board shall keep accurate records and minutes of all meetings ,
2-44 and the records and minutes so kept must be open to public inspection at all
2-45 reasonable times. The board shall also keep a record of all applications for
2-46 licenses, and licenses issued by it. The record of applications and licenses
2-47 is a public record.
