THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 457.250 is hereby amended to read as follows:
1-2 457.250 1. The chief administrative officer of each health care
1-3 facility in this state shall make available to the state health officer or his
1-4 representative the records of the health care facility for every case of
1-5 malignant neoplasms which are specified by the state board of health as
1-6 subject to reporting.
1-7 2. The health division shall abstract from the records of the health care
1-8 facility or shall require the health care facility to abstract from their own
1-9 records such information as is required by the state board of health.
1-10 3. The board shall by regulation adopt a schedule of fees which must
1-11 be assessed to the health care facility for each case from which information
1-12 is abstracted by the health division or by the health care facility pursuant to
1-13 subsection 2. The fee assessed to a facility which abstracts information
1-14 from its own records must not exceed one-third of the amount assessed to
1-15 facilities for which the health division abstracts. To the extent of legislative
1-16 appropriations available for this purpose, the board shall reduce the fees
1-17 charged to a health care facility pursuant to this subsection if the
1-18 required information is submitted in a timely manner.
1-19 4. Any person who violates this section is guilty of a misdemeanor.
1-20 Sec. 2. 1. There is hereby appropriated from the state general fund
1-21 to the Health Division of the Department of Human Resources for the
2-1 support of the system for the reporting of information on cancer maintained
2-2 by the state health officer:
2-3 For the fiscal year 2001-2002.............. $100,000
2-4 For the fiscal year 2002-2003.............. $100,000
2-5 2. The money appropriated pursuant to subsection 1 must be used to
2-6 subsidize the fees that are assessed to health care facilities that make timely
2-7 submissions of information from their records regarding cases of cancer
2-8 which occur in this state.
2-9 3. Any balance of the sums appropriated by subsection 1 remaining at
2-10 the end of the respective fiscal years must not be committed for
2-11 expenditure after June 30 of the respective fiscal years and reverts to the
2-12 state general fund as soon as all payments of money committed have been
2-13 made.
2-14 Sec. 3. This act becomes effective on July 1, 2001.
