AN ACT relating to the University and Community College System of Nevada; authorizing the board of regents of the University of Nevada to create campus review boards to review allegations of misconduct against peace officers of the police department for the system; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 396 of NRS is hereby amended by adding thereto
1-2 the provisions set forth as sections 2 to 5, inclusive, of this act.
1-3 Sec. 2. 1. The board of regents may create on each campus of the
1-4 system a campus review board to advise the president or other chief
1-5 administrative officer of the campus and, upon request, the board of
1-6 regents on issues concerning allegations made against peace officers of
1-7 the police department for the system involving misconduct while serving
1-8 on the campus.
1-9 2. A campus review board created pursuant to subsection 1 must
1-10 consist of not less than 15 members.
1-11 3. A campus review board must be appointed by the board of regents
1-12 from a list of names submitted by interested persons within the system
1-13 and in the general public. If an insufficient number of names of persons
1-14 interested in serving on a campus review board are submitted, the board
1-15 of regents shall appoint the remaining members in the manner it deems
1-16 appropriate.
1-17 4. A person appointed to a campus review board:
1-18 (a) Must be a resident of this state;
1-19 (b) Must not be employed as a peace officer;
1-20 (c) Must complete training relating to law enforcement before serving
1-21 as a member of the campus review board, including, without limitation,
2-1 training in the policies and procedures of the police department for the
2-2 system, the provisions of chapter 284 of NRS, the regulations adopted
2-3 pursuant thereto and NRS 289.010 to 289.120, inclusive, and the terms
2-4 and conditions of employment of the peace officers of the system; and
2-5 (d) Shall serve without salary, but may receive from the system such
2-6 per diem allowances and travel expenses as are authorized by the board
2-7 of regents.
2-8 Sec. 3. A campus review board created pursuant to section 2 of this
2-9 act:
2-10 1. Does not have jurisdiction over any matter in which it is alleged
2-11 that a crime has been committed.
2-12 2. Shall not abridge the rights of a peace officer of the police
2-13 department for the system that are granted pursuant to a contract or by
2-14 law.
2-15 Sec. 4. 1. A campus review board created pursuant to section 2 of
2-16 this act shall meet in panels to carry out its duties.
2-17 2. Members must be selected randomly to serve on a panel, and each
2-18 panel shall select one of its members to serve as chairman of the panel.
2-19 3. A panel of a campus review board may:
2-20 (a) Refer a complaint against a peace officer of the police department
2-21 for the system who has served on the campus to the office of the police
2-22 department for the system on the campus.
2-23 (b) Review an internal investigation of such a peace officer and make
2-24 recommendations regarding any disciplinary action against the peace
2-25 officer that is recommended by the office of the police department for the
2-26 system on the campus, including, without limitation:
2-27 (1) Increasing or decreasing the recommended level of discipline;
2-28 and
2-29 (2) Exonerating the peace officer who has been the subject of the
2-30 internal investigation.
2-31 4. The police department for the system shall make available to a
2-32 panel of a campus review board any information within a personnel file
2-33 that is specific to a complaint against a peace officer of the police
2-34 department for the system who has served on the campus, or any other
2-35 material that is specific to the complaint.
2-36 5. When reviewing an internal investigation of a peace officer of the
2-37 system pursuant to subsection 3, a panel of a campus review board shall
2-38 provide the peace officer with notice and an opportunity to be heard. The
2-39 peace officer may represent himself at the hearing before the panel or be
2-40 represented by an attorney or other person of his own choosing. The
2-41 campus review board and the police department for the system are not
2-42 responsible for providing such representation.
2-43 6. The chairman of a panel of a campus review board shall report
2-44 the findings and recommendations of the panel regarding disciplinary
2-45 action to the office of the police department for the system on the
2-46 campus, the president or other chief administrative officer of the campus
2-47 and, upon request, the board of regents.
2-48 7. A proceeding of a panel of a campus review board must be closed
2-49 to the public.
3-1 8. The findings and recommendations of a panel of a campus review
3-2 board are public records unless otherwise declared confidential by state
3-3 or federal law.
3-4 Sec. 5. 1. A panel of a campus review board created pursuant to
3-5 section 2 of this act may:
3-6 (a) Administer oaths;
3-7 (b) Take testimony;
3-8 (c) Within the scope of its jurisdiction, issue subpoenas to compel the
3-9 attendance of witnesses to testify before the panel;
3-10 (d) Require the production of books, papers and documents specific to
3-11 a complaint; and
3-12 (e) Issue commissions to take testimony.
3-13 2. If a witness refuses to attend or testify or produce books, papers or
3-14 documents as required by the subpoena, the panel may petition the
3-15 district court to order the witness to appear or testify or produce the
3-16 requested books, papers or documents.
