AN ACT relating to vehicles; restricting the authority of the department of transportation and certain local governments to authorize the operation or other movement of vehicles exceeding a certain width; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 484.743 is hereby amended to read as follows:
1-2 484.743 1. [The] Except as otherwise provided in subsection 2, the
1-3 board of directors of the department of transportation may by resolution
1-4 authorize the movement of vehicles upon the public highways, including ,
1-5 without limitation , motor vehicles, tractors, trailers, semitrailers and
1-6 combinations thereof, of a size and weight in excess of the limits
1-7 prescribed by this chapter, to such extent as may be authorized by any
1-8 legislation enacted by the Congress of the United States permitting such
1-9 increases without forfeiture of [this state’s] the eligibility of this state for
1-10 federal aid in highway construction and maintenance.
1-11 2. The board of directors of the department of transportation shall
1-12 not authorize the movement of a vehicle or combination of vehicles
1-13 whose width exceeds 102 inches if the vehicle or combination of vehicles
1-14 is used to transport radioactive material.
1-15 3. The board of directors of the department of transportation may by
1-16 resolution establish a reasonable fee or fees to be charged by the
1-17 department for the issuance of permits authorizing the operation of
1-18 oversize or overweight vehicles as provided in this chapter. The fee or fees
1-19 so established must be in an amount set so that the aggregate amounts
1-20 received from the fee or fees do not exceed the estimated costs of
1-21 administering the permit system.
2-1 Sec. 2. NRS 484.7631 is hereby amended to read as follows:
2-2 484.7631 1. [The] Except as otherwise provided in subsection 2, the
2-3 department of transportation with respect to highways under its jurisdiction
2-4 and the governing body of a city or county with respect to highways under
2-5 its jurisdiction [shall,] :
2-6 (a) Shall, upon application in writing, issue a permit to operate a
2-7 vehicle, or a vehicle with a load, having a width exceeding the legal
2-8 maximum width but not exceeding 120 inches in width on a highway,
2-9 unless the department or governing body determines that the operation
2-10 would be a safety hazard or would unduly impede the flow of traffic.
2-11 [2. The department of transportation with respect to highways under its
2-12 jurisdiction and the governing body of a city or county with respect to
2-13 highways under its jurisdiction may]
2-14 (b) May adopt regulations providing for an annual permit or a permit for
2-15 a single trip for a vehicle, or a vehicle with a load exceeding 120 inches in
2-16 width and limiting the movement of the vehicle to certain hours of the day,
2-17 days of the week or routes considered necessary to protect public safety.
2-18 2. No permit may be issued pursuant to this section authorizing the
2-19 operation of a vehicle whose width exceeds 102 inches if the vehicle is
2-20 used to transport radioactive material.
