AN ACT relating to protection from fire; providing in skeleton form for the formation of a regional fire protection district in certain counties; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Title 42 of NRS is hereby amended by adding thereto a
1-2 new chapter to consist of the provisions set forth as sections 2 to 6,
1-3 inclusive, of this act.
1-4 Sec. 2. As used in this chapter, unless the context otherwise
1-5 provides, “district” means a regional fire protection district.
1-6 Sec. 3. In a county whose population is 100,000 or more but less
1-7 than 400,000, the board of county commissioners and the governing body
1-8 of one or more incorporated cities in the county may establish a regional
1-9 fire protection district. To establish such a district, the participating
1-10 political subdivisions must each conduct a public hearing on the matter
1-11 and adopt a resolution approving the establishment of the district.
1-12 Sec. 4. The district must be governed by a board of directors. The
1-13 participating political subdivisions shall provide for the composition and
1-14 election of the board by interlocal agreement.
1-15 Sec. 5. The board of directors shall:
1-16 1. Manage and conduct the business and affairs of the district.
1-17 2. Make and enforce all rules and regulations necessary for the
1-18 administration and government of the district and for the furnishing of
1-19 fire protection thereto, which may include regulations relating to fire
1-20 prevention.
1-21 3. Organize, regulate, establish and disband fire companies,
1-22 departments or volunteer fire departments for the district.
2-1 4. Make and execute in the name of the district all necessary
2-2 contracts.
2-3 5. Adopt a seal for the district to be used in the attestation of proper
2-4 documents.
2-5 6. Provide for the payment from the proper fund of all the debts and
2-6 just claims against the district.
2-7 7. Employ agents and employees for the district sufficient to
2-8 maintain and operate the property acquired for the purposes of the
2-9 district.
2-10 8. Acquire real or personal property necessary for the purposes of
2-11 the district and dispose of that property when no longer needed.
2-12 9. Construct any necessary structures.
2-13 10. Acquire, hold and possess, either by donation or purchase, in the
2-14 name and on behalf of the district any land or other property necessary
2-15 for the purpose of the district.
2-16 11. Eliminate and remove fire hazards within the district wherever
2-17 practicable and possible, whether or not on private or public premises,
2-18 and to that end the board may clear the public highways and private
2-19 lands of dry grass, stubble, brush, rubbish or other inflammable material
2-20 which, in its judgment, constitutes a fire hazard.
2-21 12. Perform all other acts necessary, proper and convenient to
2-22 accomplish the purposes of the district.
2-23 Sec. 6. 1. The board of directors may purchase, acquire by
2-24 donation or otherwise, lease, operate and maintain ambulances
2-25 whenever necessary, and may take out liability and other insurance
2-26 therefor.
2-27 2. The board of directors may employ trained personnel to operate
2-28 these vehicles.
