AN ACT relating to cities; clarifying the authority of the first elected city council and mayor to enact and sign ordinances, respectively, to fix their own salaries and those of other officers before the incorporation of the city becomes effective; providing for the continued existence of the North Lyon County Fire Protection District following the incorporation of the City of Fernley; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 266.041 is hereby amended to read as follows:

1-2    266.041  Before the incorporation of the city becomes effective, the

1-3  elected officers of the city may:

1-4    1.  Prepare and adopt a budget;

1-5    2.  Adopt ordinances[;] , including an ordinance fixing the salaries of

1-6  the officers first elected or appointed for the city, including those officers

1-7  who enact and sign the ordinance;

1-8    3.  Levy a tax ad valorem on property within the area of the city, at the

1-9  time and in the amount prescribed by law for cities, for the fiscal year

1-10  beginning on the date the incorporation of the city becomes effective;

1-11    4.  Negotiate an equitable apportionment of the fixed assets of the

1-12  county pursuant to NRS 266.044;

1-13    5.  Negotiate contracts for the employment of personnel;

1-14    6.  Negotiate contracts to provide services for the city, including those

1-15  services provided for by chapter 277 of NRS; and


2-1    7.  Negotiate contracts for the purchase of equipment, materials and

2-2  supplies.

2-3    Sec. 2.  NRS 266.450 is hereby amended to read as follows:

2-4    266.450  All officers of any city [shall] are entitled to receive such

2-5  compensation as may be fixed by ordinance, but , except as otherwise

2-6  provided in NRS 266.041, the compensation of any such officers [shall]

2-7  may not be increased or diminished to take effect during the time for which

2-8  the officer was elected or appointed.

2-9    Sec. 3.  1.  The legislature hereby finds and declares that a general

2-10  law cannot be made applicable for the provisions of subsection 2 because

2-11  of the economic and geographic diversity of the local governments of this

2-12  state, the unusual growth patterns in certain of those local governments and

2-13  the special conditions experienced in certain counties related to the need to

2-14  provide basic services.

2-15    2.  Notwithstanding the provisions of subsection 2 of NRS 266.043, the

2-16  North Lyon County Fire Protection District may continue to exist on and

2-17  after the date on which the incorporation of the City of Fernley becomes

2-18  effective and the boundaries that district may continue to include territory

2-19  incorporated into the new City of Fernley.

2-20    Sec. 4.  This act becomes effective upon passage and approval.
