AN ACT relating to education; changing the number of members of the state board of education; revising the districts from which members of the state board of education are elected; changing the number of members of the board of regents; revising the districts from which members of the board of regents are elected; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. NRS 385.017 is hereby amended to read as follows:

1-2    385.017  As used in NRS 385.017 to 385.0265, inclusive, unless the

1-3  context otherwise requires:

1-4    1.  “Block” means the smallest geographical unit whose boundaries

1-5  were designated by the Bureau of the Census of the United States

1-6  Department of Commerce in [the precensus version of] its topographically

1-7  integrated geographic encoding and referencing system.

1-8    2.  “Block group” means a combination of blocks [in a series,] whose

1-9  numbers begin with the same digit.

1-10  3.  [“Census county division” means the geographical boundaries

1-11  identified as a census county division by the Bureau of the Census of the

1-12  United States Department of Commerce in the precensus version of its

1-13  topographically integrated geographic encoding and referencing system.

1-14  4.] “Census tract” means a combination of block groups.

1-15  [5.] 4. “Census voting district” means the voting district:

1-16  (a) Based on the geographic and population databases compiled by the

1-17  Bureau of the Census of the United States Department of Commerce as

1-18  validated and incorporated into the geographic information system by the

1-19  legislative counsel bureau for use by the Nevada legislature; and

2-1    (b) Designated in the maps filed with the office of the secretary of state

2-2  pursuant to NRS 385.0175.

2-3    Sec. 2.  NRS 385.0175 is hereby amended to read as follows:

2-4    385.0175  The director of the legislative counsel bureau shall:

2-5    1.  Retain in an office of the legislative counsel bureau, copies of maps

2-6  of the [subdistricts] districts described in NRS 385.0225 to 385.0265,

2-7  inclusive.

2-8    2.  Make available copies of the maps to any interested person for a

2-9  reasonable fee, not to exceed the actual costs of producing copies of the

2-10  maps.

2-11  3.  File a copy of the maps with the secretary of state.

2-12  Sec. 3.  NRS 385.019 is hereby amended to read as follows:

2-13  385.019  1.  If any area of this state is omitted from the provisions of

2-14  NRS 385.017 to 385.0265, inclusive, the county clerk, the Carson City

2-15  clerk or the director of the legislative counsel bureau, upon discovery of

2-16  the omission, shall notify the secretary of state of the omission. The

2-17  secretary of state shall attach that area to the appropriate [subdistrict]

2-18  district as follows:

2-19  (a) If the area is surrounded by a [subdistrict,] district, it must be

2-20  attached to that [subdistrict.] district.

2-21  (b) If the area is contiguous to two or more [subdistricts,] districts, it

2-22  must be attached to the [subdistrict] district that has the least population.

2-23  2.  Any attachments made pursuant to the provisions of this section

2-24  must be certified in writing and filed with the director of the legislative

2-25  counsel bureau and with the secretary of state. No change may be made in

2-26  any attachments until the [subdistricts] districts are again reapportioned.

2-27  Sec. 4.  NRS 385.021 is hereby amended to read as follows:

2-28  385.021  1.  The state board [of education] consists of [eleven] 10

2-29  members elected by the registered voters within the [following districts:

2-30  (a) District 1 consisting of all of Washoe County except census voting

2-31  districts 0326, 0334, 0341, 0344, 0349, 0703, 0705, 0712, 0716, 0720,

2-32  0721, 0722, 0723, 0724, 0727, 0729, 0730, 0731, 0732, 0733, 0736, 0737,

2-33  0739, 0740, 0742, 0744, 0746 and 0769, that portion of census voting

2-34  district 0771 located in the New Washoe City census county division,

2-35  census voting district 0805, that portion of census voting district 0815

2-36  located in the Pyramid Lake census county division, and census voting

2-37  districts 0816, 0817, 0818, 0832, 0833, 0834, 0902, 0903, 0910, 0930,

2-38  0933, 0935, 0939 and 0945.

2-39  (b) District 2 consisting of Clark County, Lincoln County, and, in Nye

2-40  County, census voting districts 0060, 0065, 0070, 0075, 0080, 0085, 0090

2-41  and 0095.

2-42  (c) District 3 consisting of the remainder of the state.] districts

2-43  described in NRS 385.0225 to 385.0265, inclusive.

2-44  2.  Each member of the state board must be a resident of the

2-45  [subdistrict] district from which that member is elected.

2-46  3.  At the general election in [1992,] 2002, and every 4 years

2-47  thereafter , [:

2-48  (a) From district No. 1,] one member of the state board must be elected

2-49  for a term of 4 years [.

3-1    (b) From district No. 2, four members of the state board must be elected

3-2  for a term of 4 years.

3-3    (c) From district No. 3, one member of the state board must be elected

3-5    4.  At the general election in [1994,] 2004, and every 4 years

3-13  5.  If a vacancy occurs on the state board, the governor shall appoint a

3-14  member to fill the vacancy until the next general election, at which election

3-15  a member must be chosen for the balance of the unexpired term. The

3-17  occurs.

3-18  6.  No member of the state board may be elected to the office more

3-19  than three times.

34-21  Sec. 29.  1.  Each member of the state board of education who was

34-22  elected on November 3, 1998, shall serve out the term of office for which

34-23  he was elected.

34-24  2.  Those members of the state board of education who were elected on

34-25  November 7, 2000, shall serve out their term of office for which they were

34-26  elected, and from January 7, 2003, until the expiration of their current term

34-27  of office, such members shall represent the following districts:

34-28  (a) The member elected from subdistrict G of district 2 shall represent

34-29  district 1 as described in section 5 of this act.

34-30  (b) The member elected from subdistrict A of district 2 shall represent

34-31  district 3 as described in section 7 of this act.

34-32  (c) The member elected from subdistrict D of district 2 shall represent

34-33  district 4 as described in section 8 of this act.

34-34  (d) The member elected from subdistrict F of district 2 shall represent

34-35  district 7 as described in section 11 of this act.

34-36  (e) The member elected from subdistrict B of district 1 shall represent

34-37  district 8 as described in section 12 of this act.

34-38  (f) The member elected from subdistrict B of district 3 shall represent

34-39  district 9 as described in section 13 of this act.

34-40  3.  Any vacancy must be filled for the unexpired term.

34-41  Sec. 30.  1.  Each member of the board of regents who was elected on

34-42  November 5, 1996, shall serve out the term of office for which he was

34-43  elected.

34-44  2.  Those members of the board of regents who were elected on or after

34-45  November 3, 1998, shall serve out their term of office for which they were

34-46  elected, and from January 7, 2003, until the expiration of their current term

34-47  of office, such members shall represent the following districts:

34-48  (a) The member elected from subdistrict A of district 2 shall represent

34-49  district 1 as described in section 19 of this act.

35-1    (b) The member elected from subdistrict D of district 2 shall represent

35-2  district 4 as described in section 22 of this act.

35-3    (c) The member elected from subdistrict F of district 2 shall represent

35-4  district 6 as described in section 24 of this act.

35-5    (d) The member elected from subdistrict G of district 2 shall represent

35-6  district 7 as described in section 25 of this act.

35-7    (e) The member elected from subdistrict A of district 3 shall represent

35-8  district 8 as described in section 26 of this act.

35-9    (f) The member elected from subdistrict B of district 3 shall represent

35-10  district 9 as described in section 26.5 of this act.

35-11  (g) The member elected from subdistrict B of district 1 shall represent

35-12  district 11 as described in section 14.5 of this act.

35-13  (h) The member elected from subdistrict C of district 2 shall represent

35-14  district 13 as described in section 28 of this act.

35-15  3.  Any vacancy must be filled for the unexpired term.

35-16  Sec. 31.  1.  Notwithstanding the provisions of NRS 294A.330:

35-17  (a) A member identified in subsection 2 of section 29 of this act or

35-18  subsection 2 of section 30 of this act as the representative of a renumbered

35-19  district described in this act may use the term “reelect” in any material,

35-20  statement or publication supporting the election of the member to represent

35-21  that renumbered district in the identical office at the next succeeding

35-22  election for that office.

35-23  (b) The following members of the state board of education who were

35-24  elected on November 3, 1998, may use the term “reelect” in any material,

35-25  statement or publication supporting the election of the members to

35-26  represent the following districts as members of the state board of

35-27  education:

35-28     (1) The member elected from subdistrict B of district 2, if seeking

35-29  election in 2002 to district 2 as described in section 6 of this act.

35-30     (2) The member elected from subdistrict E of district 2, if seeking

35-31  election in 2002 to district 5 as described in section 9 of this act.

35-32     (3) The member elected from subdistrict C of district 2, if seeking

35-33  election in 2002 to district 6 as described in section 10 of this act.

35-34     (4) The member elected from subdistrict A of district 3, if seeking

35-35  election in 2002 to district 10 as described in section 14 of this act.

35-36  (c) The following members of the board of regents who were elected on

35-37  November 5, 1996, may use the term “reelect” in any material, statement

35-38  or publication supporting the election of the members to represent the

35-39  following districts as members of the board of regents:

35-40     (1) The member elected from subdistrict E of district 2, if seeking

35-41  election in 2002 to district 4 as described in section 22 of this act.

35-42     (2) The member elected from subdistrict A of district 1, if seeking

35-43  election in 2002 to district 10 as described in section 27 of this act.

35-44     (3) The member elected from subdistrict A of district 1, if seeking

35-45  election in 2002 to district 10 as described in section 27 of this act.

35-46  2.  Nothing in this section authorizes a person to seek election to an

35-47  office for which he is otherwise ineligible.

36-1    Sec. 31.5. At the general election in 2002, one member of the board of

36-2  regents must be elected for an initial term of 4 years to the open seat in

36-3  district 12, described in section 14.7 of this act.

36-4    Sec. 32.  NRS 385.022, 385.0259 and 396.041 are hereby repealed.

36-5    Sec. 33.  1.  This section and sections 29, to 31.5, inclusive, become

36-6  effective on January 1, 2002.

36-7  2.  Sections 1 to 28, inclusive, and 32 become effective on January 1,

36-8  2002, for the purpose of nominating and electing members to the state

36-9  board of education and the board of regents, and on January 7, 2003, for all

36-10  other purposes.
