AN ACT relating to cancer; requiring the adoption of a state cancer plan; mandating the administrative action necessary to provide Medicaid coverage to certain patients with breast or cervical cancer; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1. Chapter 457 of NRS is hereby amended by adding thereto a

1-2  new section to read as follows:

1-3    1.  The health division, in consultation with the state board of health,

1-4  shall:

1-5    (a) In cooperation with public and private entities involved in the

1-6  detection, prevention and treatment of cancer and the rehabilitation of

1-7  victims of cancer:

1-8       (1) Develop a state cancer plan and revise the plan at least once

1-9  every 5 years; and

1-10      (2) Facilitate the formation and activities of a committee to monitor

1-11  the implementation of the components of the state cancer plan; and

1-12    (b) Publish and submit to the legislative commission a copy of the

1-13  state cancer plan and each revision of the plan.

1-14    2.  The state cancer plan must:

1-15    (a) Include a demographic assessment of the occurrences of cancer in

1-16  this state;

1-17    (b) Establish statewide:

2-1       (1) Goals and objectives for the detection, prevention and treatment

2-2  of cancer and the rehabilitation of victims of cancer; and

2-3       (2) Priorities for the allocation of resources for the detection,

2-4  prevention and treatment of cancer and the rehabilitation of victims of

2-5  cancer;

2-6    (c) Identify and assist in the procurement from the Federal

2-7  Government and other sources any available grants and other funding

2-8  for the detection, prevention and treatment of cancer and the

2-9  rehabilitation of victims of cancer;

2-10    (d) Identify and evaluate existing public and private activities,

2-11  programs and resources for the detection, prevention and treatment of

2-12  cancer and the rehabilitation of victims of cancer;

2-13    (e) Promote coalitions and partnerships to achieve the goals and

2-14  objectives set forth in the plan;

2-15    (f) Develop and promote strategies and procedures to reduce any

2-16  duplication of efforts among public and private programs for the

2-17  detection, prevention and treatment of cancer and the rehabilitation of

2-18  victims of cancer;

2-19    (g) Promote the coordination of activities for:

2-20      (1) The dissemination of information related to cancer;

2-21      (2) The provision of educational programs related to cancer; and

2-22      (3) The detection, prevention and treatment of cancer and the

2-23  rehabilitation of victims of cancer; and

2-24    (h) Consist of any other component deemed suitable and appropriate

2-25  by the health division.

2-26    Sec. 2.  Chapter 422 of NRS is hereby amended by adding thereto a

2-27  new section to read as follows:

2-28    The director shall take such action as is necessary to include in the

2-29  state plan for Medicaid the coverage authorized by section 2 of the

2-30  federal Breast and Cervical Cancer Prevention and Treatment Act of

2-31  2000, including the period of presumptive eligibility authorized by that

2-32  section.

2-33    Sec. 3.  NRS 422.240 is hereby amended to read as follows:

2-34    422.240  1.  Money to carry out the provisions of NRS 422.001 to

2-35  422.410, inclusive, and section 2 of this act and 422.580, including,

2-36  without limitation, any federal money allotted to the State of Nevada

2-37  pursuant to the program to provide temporary assistance for needy families

2-38  and the program for child care and development, must be provided by

2-39  appropriation by the legislature from the state general fund.

2-40    2.  Disbursements for the purposes of NRS 422.001 to 422.410,

2-41  inclusive, and section 2 of this act and 422.580 must be made upon claims

2-42  duly filed, audited and allowed in the same manner as other money in the

2-43  state treasury is disbursed.

2-44    Sec. 4.  The health division of the department of human resources

2-45  shall, not later than February 1, 2003, publish the state cancer plan required

2-46  pursuant to section 1 of this act and submit it to the director of the

2-47  legislative counsel bureau for transmittal to the 72nd session of the Nevada

2-48  legislature.

3-1    Sec. 5.  Section 2 of this act must not be construed to authorize or

3-2  require the state to provide any coverage authorized by section 2 of the

3-3  federal Breast and Cervical Cancer Prevention and Treatment Act of 2000

3-4  before:

3-5    1.  July 1, 2001; or

3-6    2.  The date all federal requirements are met for the state to provide that

3-7  coverage,

3-8  whichever occurs later.

3-9    Sec. 6.  This act becomes effective on July 1, 2001.
