AN ACT relating to conservation districts; revising the period for filling a vacancy in the office of supervisor of a district; revising the powers of a district and the supervisors thereof; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1    Section 1.  NRS 548.295 is hereby amended to read as follows:

1-2    548.295  1.  [Vacancies] A vacancy in the office of supervisor of a

1-3  district must be filled for the unexpired term [within 2 weeks of the

1-4  occurrence of the vacancy,] as soon as practicable after the office

1-5  becomes vacant, by appointment by the remaining supervisors of the

1-6  district.

1-7    2.  The chairman of the [district] governing body of a district shall

1-8  certify all such appointments immediately to the commission and to the

1-9  administrative officer of the division.

1-10    Sec. 2.  NRS 548.355 is hereby amended to read as follows:

1-11    548.355  In addition to other powers granted in this chapter, a district

1-12  and the supervisors thereof [shall have the power to carry] may:

1-13    1.  Carry out preventive and control measures within the district,

1-14  including, but not limited to, engineering operations, methods of

1-15  cultivation, the growing of vegetation and changes in the use of land [, on

1-16  lands] ; and

1-17    2.  Repair and restore property within the district, including, but not

1-18  limited to, wetlands, stream corridors and other riparian property,

1-19  on land owned or controlled by [this state or any of its agencies,] any

1-20  government or municipal corporation, with the cooperation of the agency

1-21  administering and having jurisdiction thereof, and on any other [lands]

1-22  land within the district, upon obtaining the consent of [the occupier of such


2-1  lands or the necessary] all persons holding any relevant rights or interests

2-2  in such [lands.] land.

2-3    Sec. 3.  NRS 548.360 is hereby amended to read as follows:

2-4    548.360  In addition to other powers granted in this chapter, a district

2-5  and the supervisors thereof [shall have the power to] may cooperate or

2-6  enter into agreements with and, within the limits of appropriations [duly]

2-7  made available to it by law [, to] and any money it acquires from any

2-8  other source, furnish financial or other aid to any governmental or other

2-9  agency, [governmental or otherwise,] or any occupier of [lands] land

2-10  within the district, in conserving renewable natural resources within the

2-11  district, subject to such conditions as the supervisors may deem necessary

2-12  to advance the purposes of this chapter.

2-13    Sec. 4.  NRS 548.380 is hereby amended to read as follows:

2-14    548.380  In addition to other powers granted in this chapter, a district

2-15  and the supervisors thereof [shall have the power:

2-16    1.  To manage] may:

2-17    1.  Manage or administer any project for the conservation of a

2-18  renewable natural resource [conservation project] located within its

2-19  boundaries undertaken by [the United States or any of its agencies, or by

2-20  this state or any of its agencies.

2-21    2.  To act as agent for the United States, or any of its agencies, or for

2-22  this state or any of its agencies,] any person, municipal corporation or

2-23  government.

2-24    2.  Act as an agent of any person, municipal corporation or

2-25  government in connection with the acquisition, construction, operation or

2-26  administration of any project for the conservation of a renewable natural

2-27  resource [conservation project] within its boundaries.

2-28    3.  [To accept] Accept donations, gifts and contributions in money,

2-29  services, materials or [otherwise from the United States or any of its

2-30  agencies, or from this state or any of its agencies, and to] any other form

2-31  from any source, and use or expend such [moneys,] money, services,

2-32  materials or other contributions in carrying on its operations.

2-33    4.  [To participate] Participate in cost-sharing on federally financed

2-34  projects.

2-35    Sec. 5.  This act becomes effective on July 1, 2001.
