AN ACT relating to conservation districts; revising the period for filling a vacancy in the office of supervisor of a district; revising the powers of a district and the supervisors thereof; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. NRS 548.295 is hereby amended to read as follows:
548.295 1. [Vacancies] A vacancy in the office of supervisor of a
district must be filled for the unexpired term [within 2 weeks of the
occurrence of the vacancy,] as soon as practicable after the office
becomes vacant, by appointment by the remaining supervisors of the
district.
2. The chairman of the [district] governing body of a district shall
certify all such appointments immediately to the commission and to the
administrative officer of the division.
Sec. 2. NRS 548.355 is hereby amended to read as follows:
548.355 In addition to other powers granted in this chapter, a district
and the supervisors thereof [shall have the power to carry] may:
1. Carry out preventive and control measures within the district,
including, but not limited to, engineering operations, methods of
cultivation, the growing of vegetation and changes in the use of land[, on
lands] ; and
2. Repair and restore property within the district, including, but not
limited to, wetlands, stream corridors and other riparian property,
on land owned or controlled by [this state or any of its agencies,] any
government or municipal corporation, with the cooperation of the agency
administering and having jurisdiction thereof, and on any other [lands]
land within the district, upon obtaining the consent of [the occupier of
such lands or the necessary] all persons holding any relevant rights or
interests in such [lands.] land.
Sec. 3. NRS 548.360 is hereby amended to read as follows:
548.360 In addition to other powers granted in this chapter, a district
and the supervisors thereof [shall have the power to] may cooperate or
enter into agreements with and, within the limits of appropriations [duly]
made available to it by law[, to] and any money it acquires from any
other source, furnish financial or other aid to any governmental or other
agency, [governmental or otherwise,] or any occupier of [lands] land
within the district, in conserving renewable natural resources within the
district, subject to such conditions as the supervisors may deem necessary
to advance the purposes of this chapter.
Sec. 4. NRS 548.380 is hereby amended to read as follows:
548.380 In addition to other powers granted in this chapter, a district
and the supervisors thereof [shall have the power:
1. To manage] may:
1. Manage or administer any project for the conservation of a
renewable natural resource [conservation project] located within its
boundaries undertaken by [the United States or any of its agencies, or by
this state or any of its agencies.
2. To act as agent for the United States, or any of its agencies, or for
this state or any of its agencies,] any person, municipal corporation or
government.
2. Act as an agent of any person, municipal corporation or
government in connection with the acquisition, construction, operation or
administration of any project for the conservation of a renewable natural
resource [conservation project] within its boundaries.
3. [To accept] Accept donations, gifts and contributions in money,
services, materials or [otherwise from the United States or any of its
agencies, or from this state or any of its agencies, and to] any other form
from any source, and use or expend such [moneys,] money, services,
materials or other contributions in carrying on its operations.
4. [To participate] Participate in cost-sharing on federally financed
projects.
Sec. 5. This act becomes effective on July 1, 2001.
