AN ACT relating to motorcycles; limiting the requirement for protective headgear for
drivers and passengers; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 486.231 is hereby amended to read as follows:
1-2 486.231 1. The department shall adopt standards for
protective
1-3 headgear and protective
glasses, goggles or face shields to be worn by the
1-4 drivers and passengers of
motorcycles and transparent windscreens for
1-5 motorcycles.
1-6 2. Except as otherwise provided in this
section, when any motorcycle,
1-7 except a trimobile or moped,
is being driven on a highway, the driver and
1-8 passenger shall wear
protective headgear securely fastened on the head and
1-9 protective glasses, goggles
or face shields meeting those standards. Drivers
1-10 and passengers of trimobiles
shall wear protective glasses, goggles or face
1-11 shields which meet those
standards.
1-12 3. When a motorcycle or a
trimobile is equipped with a transparent
1-13 windscreen meeting those
standards, the driver and passenger are not
1-14 required to wear glasses,
goggles or face shields.
2-1 4. When a motorcycle is
being driven in a parade authorized by a local
2-2 authority, the driver and
passenger are not required to wear the protective
2-3 devices provided for in this
section.
2-4 5. When a three-wheel
motorcycle, on which the driver and passengers
2-5 ride within an enclosed cab,
is being driven on a highway, the driver and
2-6 passengers are not required
to wear the protective devices required by this
2-7 section.
2-8 6. A driver of a motorcycle is not required to
wear protective
2-9 headgear if he:
2-10 (a) Is 21 years of age or
older; and
2-11 (b) Is licensed to drive a
motorcycle.
2-12 7. The passenger on a motorcycle is not required
to wear protective
2-13 headgear if:
2-14 (a) The passenger is 21
years of age or older; and
2-15 (b) The driver of the
motorcycle is not required to wear protective
2-16 headgear.
