AN ACT relating to the City of North Las Vegas; authorizing the city council to appoint
certain professional corporations, partnerships or limited-liability companies
to perform the duties of the city attorney; requiring each attorney employed by
or associated with such a corporation, partnership or limited-liability company
to be a member of the State Bar of Nevada under certain circumstances; and
providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Section 3.050 of the charter of the City of North Las
1-2 Vegas, being chapter 573,
Statutes of Nevada 1971, as amended by chapter
1-3 159, Statutes of Nevada
1999, at page 838, is hereby amended to read as
1-4 follows:
1-5 Sec. 3.050 City attorney:
Appointment; salary; qualifications;
1-6 duties; removal [.
1-7 1. The] ; appointment of professional corporation, partnership
1-8 or limited-liability company to perform duties of city attorney.
1-9 1. Except as otherwise provided in subsection 6, the city council
1-10 shall appoint a city
attorney and fix his salary.
1-11 2. [The]
Except as otherwise provided in
subsection 6, the city
1-12 attorney must be a [duly]
licensed member of the State Bar of Nevada.
1-13 3. The city attorney is the
chief legal officer of the city and shall
1-14 perform such duties as may
be designated by the city council or
1-15 prescribed by ordinance.
1-16 4. The city attorney is
under the general direction and supervision
1-17 of the city council.
2-1 5. The city attorney serves
at the pleasure of the city council and
2-2 may be removed by an
affirmative vote of a majority of the entire
2-3 membership of the city
council at any time.
2-4 6. In lieu of or in addition to appointing a city attorney pursuant
2-5 to the provisions of subsection 1, the city council may appoint a
2-6 professional corporation, partnership or limited-liability company
2-7 that engages in the practice of law in this state to perform all or
a
2-8 portion of the duties of the city attorney designated by the city
2-9 council or prescribed by ordinance pursuant to the provisions of
this
2-10 section. If the city council appoints a professional corporation,
2-11 partnership or limited-liability company to perform all or a
portion
2-12 of those duties:
2-13 (a) The city council shall
establish the compensation payable to
2-14 the professional corporation, partnership or limited-liability
2-15 company for performing those duties; and
2-16 (b) Each attorney employed by
or associated with the
2-17 professional corporation, partnership or limited-liability company
2-18 must be a licensed member of the State Bar of Nevada if the
2-19 attorney performs or assists in performing any of those duties.
2-20 7. A professional corporation, partnership or limited-liability
2-21 company that is appointed to perform all or a portion of the duties
of
2-22 the city attorney pursuant to the provisions of subsection 6 has,
for
2-23 each of those duties, all the powers and duties otherwise conferred
2-24 upon a city attorney who is appointed pursuant to the provisions of
2-25 subsection 1.
